【摘要】：先秦法家進(jìn)化論以其"因時(shí)而變"的變法主張和"法今王"的政治取向,并貫之以清醒的人性論認(rèn)識(shí)和功利務(wù)實(shí)精神,服務(wù)于當(dāng)時(shí)各國(guó)企望"富國(guó)強(qiáng)兵"的改革實(shí)踐。這一極具革命性的學(xué)說,在某種程度上突破了古代的循環(huán)時(shí)間觀,與受基督教線性時(shí)間觀影響的近代西方社會(huì)達(dá)爾文主義和馬克思主義社會(huì)歷史觀存在某些相近之處。比較它們之間異同的意義在于,一方面,有助于理解社會(huì)達(dá)爾文主義在近代中國(guó)與先秦法家思想相結(jié)合并產(chǎn)生廣泛影響的條件和原因;另一方面,有助于重新詮釋和認(rèn)識(shí)法家進(jìn)化論的當(dāng)代價(jià)值,以期為"法治中國(guó)"建設(shè)提供源自本土文化的助益。
[Abstract]:The evolution theory of the Legalists in the Pre-Qin Dynasty served the reform practice of "rich country and strong army" with its "changing from time to time" and the political orientation of "law today king", as well as the sober understanding of human nature and the pragmatic spirit of utilitarianism. To some extent, this extremely revolutionary theory breaks through the ancient concept of cyclic time and has some similarities with the modern western social Darwinism and Marxist social historical view influenced by the Christian linear view of time. The significance of comparing them is that, on the one hand, it is helpful to understand the conditions and reasons for the combination of social Darwinism in modern China and the thought of Legalists in the Pre-Qin Dynasty. On the other hand, it is helpful to reinterpret and understand the contemporary value of Legalist Evolutionism in order to provide the help from local culture for the construction of "China ruled by Law".
