【摘要】：西周法律思想圍繞著"天命"、"王權(quán)"、"民本"、"規(guī)則"四個(gè)方面進(jìn)行了系統(tǒng)建構(gòu)。天命的權(quán)威性、平等性以及可轉(zhuǎn)移性思想使天命的神圣性得以凸顯。而王權(quán)的代理性、受限制性、受監(jiān)督性及地域性思想,導(dǎo)致了王權(quán)思想的弱化狀態(tài)。民本思想強(qiáng)調(diào)王權(quán)自身的勤政無(wú)逸和對(duì)民眾安全、富裕、健康和安定等方面的關(guān)心和維護(hù),展現(xiàn)了民眾追求幸福的正當(dāng)性。而規(guī)則作為社會(huì)治理的重要工具,其思想展現(xiàn)了規(guī)則的多元化和正義性特征以及強(qiáng)調(diào)規(guī)則的具體的實(shí)施。四個(gè)方面的思想構(gòu)成西周法律思想體系,蘊(yùn)含著西周時(shí)期我國(guó)法律精神的邏輯理性和正義內(nèi)涵,奠定了中華民族傳統(tǒng)文化發(fā)展的基礎(chǔ)。
[Abstract]:The legal thought of Western Zhou Dynasty is systematically constructed in four aspects: destiny, Wang Quan, people first and rules. The authoritativeness, equality, and transferability of destiny make the sanctity of destiny manifest. Wang Quan's thought of representative reason, restricted, supervised and regional led to the weakening state of Wang Quan's thought. The people-oriented thought emphasizes Wang Quan's own diligence and care and maintenance for the people's safety, affluence, health and stability, which shows the legitimacy of the people's pursuit of happiness. As an important tool of social governance, the thought of rules shows the pluralistic and just characteristics of rules and emphasizes the concrete implementation of rules. The four aspects constitute the legal ideology system of the Western Zhou Dynasty, which contains the logical rationality and the just connotation of the legal spirit of our country during the Western Zhou Dynasty, and lays the foundation for the development of the traditional culture of the Chinese nation.
