【摘要】：中華法系生成于中國本土,是中華民族智慧和理性的結晶。她以其悠久的歷史、豐富的內涵、鮮明的特色和廣泛而深遠的影響受到世界的認可與尊重,是世界五大法系之一。而在清末修律大潮中,中華法系遭到了解體。中華法系體現(xiàn)了中華民族偉大的創(chuàng)造力和深厚的法文化底蘊。研究中華法系有利于我們對當代中國特色社會主義法制的全面認識,有利于增強我們的民族自豪感和造就一個偉大中國的自信心。而對中華法系在近代的解體及其原因的研究卻少有論證。對中華法系解體的原因分析是研究中華法系的重要組成部分,對探究法系進化的條件有直接的理論意義,對當代中國特色社會主義的法制建設與發(fā)展具有重要的歷史借鑒意義。 全文共分為四個部分。 第一部分：主要對中華法系的形成、發(fā)展和特點進行了分析。 第二部分：主要對鴉片戰(zhàn)爭后的清末中國、日本、越南和朝鮮等國環(huán)境的變化進行分析,揭示近代化對中華法系的影響。 第三部分：著力對中華法系解體的原因分析,這是全文的核心部分。中華法系的解體有著深刻的內部原因和外部原因,同時也是中華法系本身矛盾運動的結果。就其內部原因,本文分別從中華法系自身的封閉性和保守性進行剖析；外部原因,則主要從國內經(jīng)濟、政治、思想文化以及西方資本主義的入侵四個方面著手分析。 第四部分：試圖總結中華法系解體的歷史啟示。通過對中華法系解體原因的分析,并結合與西方幾大法系的比較,得出中華法系解體的歷史經(jīng)驗教訓。
[Abstract]:The Chinese legal system is the crystallization of the wisdom and rationality of the Chinese nation. She is recognized and respected by the world because of her long history, rich connotation, distinctive characteristics and extensive and far-reaching influence, and is one of the five major legal systems of the world. In the late Qing Dynasty, the Chinese legal system was disintegrated. The Chinese legal system embodies the great creativity of the Chinese nation and profound legal culture. The study of the Chinese legal system is conducive to our comprehensive understanding of the socialist legal system with contemporary Chinese characteristics, to the enhancement of our national pride and to the building of the self-confidence of a great China. However, the research on the disintegration of the Chinese legal system in modern times and its causes is seldom demonstrated. The analysis of the causes of the disintegration of the Chinese legal system is an important part of the study of the Chinese legal system, which is of direct theoretical significance to the exploration of the conditions for the evolution of the legal system, and of great historical significance to the construction and development of the legal system of socialism with Chinese characteristics. The full text is divided into four parts. The first part mainly analyzes the formation, development and characteristics of Chinese legal system. The second part mainly analyzes the changes in the environment of China, Japan, Vietnam and Korea after the Opium War, and reveals the influence of modernization on the Chinese legal system. The third part: focus on the causes of the disintegration of the Chinese legal system, which is the core part of the full text. The disintegration of the Chinese legal system has profound internal and external reasons, and it is also the result of the contradictory movement of the Chinese legal system itself. As to the internal reasons, this paper analyzes the closeness and conservatism of the Chinese law system, and the external reasons mainly from the four aspects of domestic economy, politics, ideology and culture, and the invasion of western capitalism. The fourth part: try to summarize the historical enlightenment of the disintegration of Chinese legal system. Through the analysis of the causes of the disintegration of the Chinese legal system and the comparison with several western legal systems, the historical experience and lessons of the disintegration of the Chinese legal system are obtained.
