【摘要】：中國(guó)特色社會(huì)主義法治思想是改革開放以來,中國(guó)共產(chǎn)黨人將馬克思主義法學(xué)理論的基本原理同中國(guó)法治的具體實(shí)踐相結(jié)合并在實(shí)踐中豐富和發(fā)展馬克思主義法學(xué)理論的產(chǎn)物,是馬克思主義法學(xué)理論中國(guó)化的重要成果,它豐富和發(fā)展了馬克思主義法學(xué)理論,構(gòu)成了社會(huì)主義法治實(shí)踐的理論基礎(chǔ)。 本文主要介紹鄧小平理論中的法治思想,“三個(gè)代表”思想中的法治思想及科學(xué)發(fā)展觀中的法治思想,構(gòu)成了中國(guó)特色社會(huì)主義法治思想的主要內(nèi)容。鄧小平民主法制思想是中國(guó)特色社會(huì)主義法治思想的開端,對(duì)中國(guó)特色社會(huì)主義法治思想的形成奠定了重要的理論基礎(chǔ),江澤民繼承和發(fā)展了鄧小平的民主法制思想,并且提出了依法治國(guó)的治國(guó)方略,在中國(guó)法治道路上具有里程碑的意義,進(jìn)入新世紀(jì)以來,以胡錦濤同志為總書記的黨中央從中國(guó)特色社會(huì)主義事業(yè)全局出發(fā),在認(rèn)真總結(jié)我國(guó)社會(huì)主義法治建設(shè)的經(jīng)驗(yàn)和借鑒人類法治文明成果的基礎(chǔ)上,以科學(xué)發(fā)展觀為指導(dǎo),提出了一系列法治思想。中國(guó)特色社會(huì)主義法治思想的形成和發(fā)展帶給我們多方面的啟示。
[Abstract]:The thought of rule by law of socialism with Chinese characteristics is the product of the Communist Party of China combining the basic principles of Marxist legal theory with the concrete practice of Chinese rule of law and enriching and developing Marxist legal theory in practice since the reform and opening up. It enriches and develops Marxist legal theory and constitutes the theoretical basis of socialist legal practice. This paper mainly introduces the thought of rule by law in Deng Xiaoping's theory, the thought of rule by law in the thought of "three represents" and the thought of rule of law in the view of scientific development, which constitutes the main content of the thought of ruling by law with Chinese characteristics. Deng Xiaoping's thought of democracy and legal system is the beginning of the thought of ruling by law of socialism with Chinese characteristics, which has laid an important theoretical foundation for the formation of the thought of ruling by law with Chinese characteristics. And put forward the general plan of governing the country according to law, which is of milestone significance on the road of ruling by law in China. Since the beginning of the new century, the CPC Central Committee with Comrade Hu Jintao as its general secretary has set out from the overall situation of the cause of socialism with Chinese characteristics. On the basis of summing up the experience of the construction of socialist rule of law in our country and drawing lessons from the achievements of the civilization of human rule of law, a series of thoughts on the rule of law are put forward under the guidance of the scientific concept of development. The formation and development of the socialist rule of law with Chinese characteristics brings us enlightenment in many aspects.
