中美房地產(chǎn)經(jīng)紀(jì)管理法律制度比較研究
[Abstract]:Since the reform and opening up, real estate brokers ushered in historic opportunities for development. Its rapid development not only provides great convenience for consumers to buy and lease real estate, but also helps to reduce the development risk of developers, save social transaction costs, prosper and enliven the real estate market, and promote the circulation of real estate. Real estate agents become the lubricant necessary for the operation of this large machine in the real estate market. However, in the process of the rapid development of real estate brokers, the laws and regulations on real estate brokers show serious lag and vacancy, which makes real estate brokers lack of legal protection and constraints, and exposes many deficiencies in management. It affects the healthy development of the real estate brokerage industry, breeds a series of social problems, such as lack of credit, and brings serious harm to the credibility of the real estate brokerage industry. In order to solve these problems, many scholars began to study the perfect legal system of real estate brokerage management in the United States, trying to learn from the experience of the legal system of American real estate brokerage management, but the effect was not good. Because of the lack of a real and systematic study of the legal system of real estate brokerage management in the United States and the feasibility of its application in China, most of the theoretical studies are still comparative studies from the perspectives of economics and management. The research on legal issues is scattered in other research areas, few from the perspective of law to the legal system of real estate brokerage management in China and the United States, a special system of comparative research. Therefore, this paper intends to study the real estate brokerage management in the United States from the legal point of view, and combining with the actual situation in China, compares the legal system of real estate broker management between China and the United States, and puts forward some suggestions that China can use for reference to the American model.
