【摘要】：傳統(tǒng)理論在法律體系中解釋法律和道德的關(guān)系,形成了邏輯自足的法學(xué)理論,但對國家治理體系中的法治和德治關(guān)系缺乏解釋力。運用嵌入理論分析,依法治國和以德治國相結(jié)合是國家治理體系中的制度性原則,形成相互嵌入的結(jié)構(gòu),產(chǎn)生相互規(guī)訓(xùn)的功能。法治和德治的相互嵌入產(chǎn)生弱連接關(guān)系和強連接關(guān)系,形成各具功能的規(guī)范結(jié)構(gòu)和規(guī)范類型。密度確立了法治和德治相互嵌入的原則、程度和邊界。在密度作用下,既要防止形式主義法治的道德空洞性,也要防止寄生于實質(zhì)主義法治中的道德民粹主義和法律道德主義。
[Abstract]:The traditional theory interprets the relationship between law and morality in the legal system, which forms the logical self-sufficient legal theory, but lacks the explanatory power to the relationship between the rule of law and the rule of virtue in the national governance system. Based on the analysis of embedding theory, the combination of rule of law and rule of virtue is the institutional principle in the system of national governance, which forms the structure of mutual embedding and produces the function of mutual discipline and discipline. The mutual embedding of rule of law and rule of virtue leads to weak connection relation and strong connection relation, and forms each functional norm structure and norm type. Density establishes the principle, degree and boundary of mutual embedding of rule by law and rule by virtue. Under the action of density, we should not only prevent the moral hollowness of formalism rule of law, but also prevent moral populism and legal moralism, which are parasitic on the rule of law of substance doctrine.
