【摘要】：馬克思法哲學(xué)思想的研究一直是理論界關(guān)注的重大課題。在全球化時(shí)代,傳統(tǒng)的馬克思法哲學(xué)理論面臨巨大的挑戰(zhàn)。本文圍繞如何在全球化視域下解讀馬克思法哲學(xué)的問題,試圖構(gòu)建一種兼顧批判性與建設(shè)性維度的法哲學(xué)理論。在馬克思法哲學(xué)框架內(nèi),對(duì)“世界歷史”中法律的哲學(xué)反思成為了研究的主題。本文首先闡述了法律全球化問題和法律全球化對(duì)傳統(tǒng)法哲學(xué)提出的挑戰(zhàn),并確定了馬克思法哲學(xué)思想探索視域；緊接著論述了馬克思法哲學(xué)思想的形成；然后解讀了馬克思法哲學(xué)思想的意蘊(yùn),主要分四個(gè)層面：“實(shí)踐”基礎(chǔ)上的歷史唯物主義法哲學(xué)、以人“類本質(zhì)”為特征的法哲學(xué)、“統(tǒng)一的法律”的法哲學(xué)、“法律消亡”的法哲學(xué)；再接著分析了國內(nèi)外對(duì)馬克思法哲學(xué)思想繼承與異化；最后試圖在馬克思法哲學(xué)思想的指導(dǎo)下初步重構(gòu)我國當(dāng)代法哲學(xué)理論體系。
[Abstract]:The study of Marxist philosophy of law has always been a major concern of the theoretical circle. In the era of globalization, the traditional Marxist philosophy of law is facing a great challenge. Focusing on how to interpret Marxist philosophy of law from the perspective of globalization, this paper attempts to construct a theory of philosophy of law that takes into account both critical and constructive dimensions. Within the framework of Marx's philosophy of law, philosophical reflection on law in World History has become the subject of study. This paper first expounds the problem of legal globalization and the challenge of legal globalization to the traditional philosophy of law, and determines the scope of exploration of Marxist philosophy of law, and then discusses the formation of Marxist philosophy of law. Then it interprets the meaning of Marx's philosophy of law, which is divided into four levels: the philosophy of historical materialism on the basis of "practice", the philosophy of law characterized by the "nature of human beings" and the philosophy of law of "unified law". The legal philosophy of "law wither away"; then it analyzes the inheritance and alienation of Marx's philosophy of law at home and abroad; finally, it tries to reconstruct the theoretical system of contemporary legal philosophy of our country under the guidance of Marxist philosophy of law.
