【摘要】：當(dāng)前,中國(guó)正處于社會(huì)轉(zhuǎn)型以及社會(huì)矛盾頻發(fā)的特殊時(shí)期,人民群眾對(duì)法治的呼喚和期待極其迫切,對(duì)法治觀的研究有助于豐富和發(fā)展中國(guó)特色社會(huì)主義法治理論體系,為中國(guó)法治建設(shè)提供科學(xué)的理論支撐。法治觀不僅是一個(gè)熱點(diǎn)理論問(wèn)題,同時(shí)又是一個(gè)重要的實(shí)踐問(wèn)題。法治的實(shí)現(xiàn),更多的是通過(guò)人們的自然習(xí)慣和逐步養(yǎng)成的法治觀念來(lái)表現(xiàn)。因此,對(duì)于法治觀問(wèn)題的研究,不僅有深刻的理論意義,也有重大的實(shí)踐意義。本文從法治、人治、法制等相近概念的比較分析入手,梳理了法治觀和社會(huì)主義法治觀的產(chǎn)生與發(fā)展,并運(yùn)用文獻(xiàn)研究法、比較分析法對(duì)社會(huì)主義法治觀的內(nèi)涵和特征進(jìn)行了概括。通過(guò)法治觀與法治實(shí)踐的密切關(guān)系分析我國(guó)法治觀的發(fā)展?fàn)顩r,主要從中國(guó)共產(chǎn)黨、各級(jí)政府機(jī)關(guān)和普通人民群眾的權(quán)利意識(shí)、法治思維以及在立法、執(zhí)法、司法、守法四個(gè)法治建設(shè)的主要實(shí)踐環(huán)節(jié)中體現(xiàn)法治觀念的相關(guān)言行為依據(jù),對(duì)中國(guó)特色社會(huì)主義法治觀取得的成就和問(wèn)題進(jìn)行了總結(jié)。在明確加強(qiáng)法治觀建設(shè)的目標(biāo)的基礎(chǔ)上,從明確立法宗旨,提升立法為民意識(shí)、明確政府職責(zé),提升依法行政意識(shí)、加強(qiáng)司法建設(shè),提升公正司法意識(shí)以及建設(shè)社會(huì)主義法治文化環(huán)境,提升公民的法治意識(shí)四個(gè)方面探索了加強(qiáng)中國(guó)特色社會(huì)主義法治觀建設(shè)的具體路徑,以期為我國(guó)法治觀的建設(shè)獻(xiàn)計(jì)獻(xiàn)策。
[Abstract]:At present, China is in a special period of social transition and frequent social contradictions. The people's call and expectation for the rule of law is extremely urgent. The study of the concept of rule of law is helpful to enrich and develop the theoretical system of socialist rule of law with Chinese characteristics. To provide scientific theoretical support for the construction of China's rule of law. The concept of rule of law is not only a hot theoretical issue, but also an important practical problem. The realization of the rule of law, more through people's natural habits and gradually developed the concept of the rule of law. Therefore, the study of the concept of rule of law has not only profound theoretical significance, but also great practical significance. This paper starts with the comparative analysis of the similar concepts such as rule by law, rule by man and legal system, combs the emergence and development of the concept of rule by law and the view of socialist rule of law, and applies the method of literature research. Comparative analysis summarizes the connotation and characteristics of socialist view of rule of law. Through the close relationship between the concept of the rule of law and the practice of the rule of law, this paper analyzes the development of the concept of the rule of law in China. Based on the related words and deeds which embody the concept of rule of law in the four main practical links of law-abiding construction, this paper summarizes the achievements and problems of the concept of rule of law in socialism with Chinese characteristics. On the basis of making clear the aim of strengthening the concept of rule of law, we should make clear the aim of legislation, promote the consciousness of legislation for the people, clarify the responsibility of government, enhance the consciousness of administration according to law, and strengthen the construction of judicature. In order to make suggestions for the construction of the concept of the rule of law in China, the author explores the concrete ways of strengthening the construction of the concept of the rule of law with Chinese characteristics in four aspects, such as enhancing the sense of justice and constructing the cultural environment of socialist rule of law, and raising the awareness of the rule of law of citizens.
