【摘要】：新修訂的《立法法》賦予了設(shè)區(qū)的市以立法權(quán),此次"賦權(quán)"邏輯可以概括為是基層治理語境下的一種表達(dá)。作為現(xiàn)代法治建設(shè)中的秩序維系的需要,設(shè)區(qū)的市立法權(quán)的獲立能有效地應(yīng)對(duì)地區(qū)治理困境,為權(quán)力正確運(yùn)行提供約束力和制度保證。而立法能力是設(shè)區(qū)的市行使立法權(quán)的前提,同時(shí)也是設(shè)區(qū)的市做好立法工作的核心和關(guān)鍵。由此要求設(shè)區(qū)的市立法能力建設(shè)要加快進(jìn)程,通過優(yōu)化立法資源配置,明確立法主導(dǎo)能力,提升立法項(xiàng)目選擇能力,增強(qiáng)法規(guī)草案起草能力,完善立法后評(píng)估能力等舉措,迅速提升立法能力與水平,為設(shè)區(qū)的市立良法、施善法打下堅(jiān)實(shí)基礎(chǔ)。
[Abstract]:The newly revised "legislation Law" gives legislative power to the municipalities that are divided into districts, and the logic of "empowerment" can be summarized as an expression in the context of grass-roots governance. As the need of maintaining order in the construction of modern rule of law, the establishment of district legislative power can effectively deal with the dilemma of regional governance and provide binding force and system guarantee for the correct operation of power. The legislative ability is the prerequisite for the district city to exercise its legislative power, and also the core and key for the district city to do the legislative work well. Therefore, it is necessary to speed up the process of legislative capacity building in districts, by optimizing the allocation of legislative resources, clarifying the leading capacity of legislation, enhancing the ability to select legislative projects, strengthening the ability to draft laws and regulations, and perfecting the ability of post-legislative evaluation, and so on. Improve the legislative ability and level quickly, lay a solid foundation for the district-based municipal law.
