公民文化與法治秩序

【摘要】：公民文化是一種基于公民身份和行為的一系列觀念、態(tài)度、品行及價值取向,代表著現(xiàn)代民主參與精神和法治信念。歷史表明,公民文化從古希臘、古羅馬就開始孕育、生成,并分別呈現(xiàn)出整體主義精神、依附屈從精神。中世紀后,臣民文化取而代之,但伴隨著城市的興起,則衍生了近代公民文化。它經過啟蒙運動的成熟發(fā)展之后,實現(xiàn)了向公民文化的現(xiàn)代性轉向,從而成為了西方法治秩序不可或缺的重要文化基礎與價值支撐。轉型國家的經驗告訴我們,公民文化構成了其法治進程的重要價值基礎。在當代,公民文化發(fā)生了新的轉向和嬗變,構成了法治反思和變革的重要推動力量。所有這些表明,公民文化是法治進程的一個非正式制度要素和內驅力,它賦有導向、整合與反思功能,進而成為倫理秩序和法治秩序的內在支撐與契合機制。因此,要推進民主和建立法治國家,就必須對公民文化進行重建,促進由主人意識向公民意識的轉型,促進公民文化功能的充分發(fā)揮,進而培育法治的深層文化根基,推動內在自覺的法治秩序的形成。
[Abstract]:Civic culture is a series of concepts, attitudes, conduct and value orientations based on citizenship and behavior. It represents the spirit of modern democratic participation and belief in the rule of law. History shows that civic culture began to breed and form from ancient Greece and ancient Rome, and presented the spirit of holism and subservience respectively. After the Middle Ages, the subject culture took its place, but with the rise of the city, the modern citizen culture was derived. After the mature development of the Enlightenment, it has turned to the modernity of citizen culture, which has become an indispensable cultural foundation and value support for the order of rule of law in the west. The experience of countries in transition tells us that civic culture forms an important value basis for the process of rule of law. In contemporary times, citizen culture has changed and changed, which constitutes an important driving force for the reflection and reform of the rule of law. All these indicate that citizen culture is an informal institutional element and driving force in the process of ruling by law, which has the functions of guidance, integration and reflection, and then becomes the internal support and fit mechanism of the ethical order and the order of ruling by law. Therefore, in order to promote democracy and establish a country ruled by law, we must rebuild the civic culture, promote the transition from master consciousness to citizen consciousness, and promote the full play of citizen's cultural function, and then cultivate the deep cultural foundation of the rule of law. Promote the formation of the internal conscious order of the rule of law.
