【摘要】：中國和美國分屬不同的政治制度和法系,經(jīng)濟法也呈現(xiàn)出各自不同的特征,這是由于兩國不同的歷史發(fā)展軌跡和特殊的歷史背景、文化背景、經(jīng)濟背景所決定的。但是作為社會主義經(jīng)濟法的中國經(jīng)濟法與作為資本主義經(jīng)濟法的美國經(jīng)濟法并不是完全不同的,二者之前存在著一定的共性,這是現(xiàn)代經(jīng)濟法的內(nèi)在特征所決定的。本文意在從中美兩國經(jīng)濟法比較之中,發(fā)現(xiàn)資本主義經(jīng)濟法和社會主義經(jīng)濟法的共性和不同之處,為我國經(jīng)濟法對資本主義經(jīng)濟法的借鑒提供理論參考。具體來講,中美經(jīng)濟法的產(chǎn)生模式不同、經(jīng)濟民主與經(jīng)濟集中的程度不同、宏觀調(diào)控的力度不同等。但是二者都是現(xiàn)代經(jīng)濟法,都是國家之手和市場之首的協(xié)同并用,體現(xiàn)著政策性和經(jīng)濟性特征,其內(nèi)在一致性也使得二者存在著相互借鑒的可能。在對美國資本主義經(jīng)濟法的借鑒過程中,要充分認識到經(jīng)濟法領(lǐng)域法律移植的重要性,選擇適當?shù)闹贫冗M行移植,并且在移植的過程中要注意本土化問題和適當?shù)某傲⒎?為我國經(jīng)濟法法制現(xiàn)代化和社會主義和諧社會的建設(shè)做出貢獻。
[Abstract]:China and the United States belong to different political systems and legal systems, and economic law also presents different characteristics, which is determined by the different historical development tracks and special historical background, cultural background and economic background of the two countries. However, the Chinese economic law as the socialist economic law is not completely different from the American economic law as the capitalist economic law. There are certain commonalities between them, which is determined by the inherent characteristics of the modern economic law. The purpose of this paper is to find out the commonness and difference between capitalist economic law and socialist economic law from the comparison of economic law between China and the United States, and to provide a theoretical reference for the reference of Chinese economic law to capitalist economic law. Specifically, the economic laws of China and the United States are produced in different modes, the degree of economic democracy and economic concentration is different, and the intensity of macro-control is not equal. However, both of them are modern economic law, and they are the coordination of the hands of the country and the head of the market, which embodies the characteristics of policy and economy, and their internal consistency also makes it possible for them to draw lessons from each other. In the process of drawing lessons from the American capitalist economic law, we should fully realize the importance of legal transplantation in the field of economic law, choose the appropriate system to transplant, and pay attention to the localization problem and appropriate advanced legislation in the process of transplantation. It contributes to the modernization of the legal system of economic law and the construction of a harmonious socialist society.
