【摘要】：美國《反海外腐敗法》是美國政府為了遏制美國企業(yè)在跨國經(jīng)濟活動中的商業(yè)賄賂行為,即“海外腐敗行為”而制訂的,是目前規(guī)制美國企業(yè)對外行賄的最主要法律。 本文分為兩個大部分：第一部分由本文的第一章、第二章和第三章構(gòu)成,這部分的主題是介紹與分析美國《反海外腐敗法》及世界反腐立法；第二部分由本文的第四章構(gòu)成,這部分的主題是結(jié)合美國《美國反海外腐敗法》,評析中國反腐制度的現(xiàn)狀與發(fā)展。 本文首先介紹了美國《反海外腐敗法》,即寬泛嚴苛的法條以及司法部的意見程序和違法者的自我主動披露這兩個特色制度,在介紹分析了美國《反海外腐敗法》的優(yōu)點之后,筆者分析了美國《反海外腐敗法》有待改進之處。接著,筆者又進一步介紹了近年來美國《反海外腐敗法》的訴訟及執(zhí)行趨勢及美國《反海外腐敗法》的國際影響和相關(guān)世界反腐立法,希望讀者可以從動態(tài)發(fā)展的角度進一步理解美國《反海外腐敗法》這一影響全球的特色法律。 研究美國《反海外腐敗法》的重要目的就是“為我所用”。因此,本文的第四章便首先從美國《反海外腐敗法》對中國的影響以及中國現(xiàn)有反腐立法和執(zhí)法縱覽出發(fā),比較分析了中美反腐立法的異同之后,筆者提出了美國《反海外腐敗法》在立法和執(zhí)法方面值得中國借鑒之處,包括先進的立法理念、科學而成熟的立法技術(shù)以及行之有效的制度。第四章最后再度聚焦國內(nèi),筆者提出了對中國反腐工作的五點建議,以期給中國反腐工作帶來一些新的思路。
[Abstract]:The United States Anti-overseas Corruption Act (ACA) is formulated by the United States Government to curb the commercial bribery of American enterprises in transnational economic activities, that is, "overseas corruption". It is the most important law that regulates the bribery of American enterprises abroad at present. This paper is divided into two parts: the first part is composed of the first chapter, the second chapter and the third chapter. The theme of this part is to introduce and analyze the United States Anti-overseas Corruption Act and the world anti-corruption legislation, the second part is composed of the fourth chapter. The theme of this part is to analyze the current situation and development of China's anti-corruption system combined with American Anti-overseas Corruption Act. This paper first introduces the United States Anti-overseas Corruption Act, that is, the broad and strict provisions, as well as the Department of Justice's opinion procedures and the self-initiative disclosure of offenders. After introducing and analyzing the advantages of the United States Anti-overseas Corruption Act, The author analyzes the improvement of American Anti-overseas Corruption Act. Then, the author further introduces the litigation and enforcement trend of the United States' overseas Corruption Act in recent years, the international influence of the United States' Anti-overseas Corruption Act and the relevant world anti-corruption legislation. It is hoped that readers can further understand, from a dynamic point of view, the United States overseas Corruption Act, a unique law that affects the whole world. The important purpose of studying the American ACA is to use it for me. Therefore, the fourth chapter of this paper first analyzes the similarities and differences of the anti-corruption legislation between China and the United States, starting from the impact of the United States Anti-overseas Corruption Act on China and the overview of China's existing anti-corruption legislation and law enforcement. The author points out that the United States Anti-overseas Corruption Law is worthy of China's reference in terms of legislation and enforcement, including advanced legislative ideas, scientific and mature legislative techniques and effective systems. At last, the author puts forward five suggestions to China's anti-corruption work, in order to bring some new ideas to China's anti-corruption work.
