全面深化改革應(yīng)當(dāng)加強(qiáng)立法能力建設(shè)

【摘要】：中共十八大以來,我國立法工作取得了舉世矚目的顯著成績。但在新形勢(shì)下,全面深化改革對(duì)立法提出了一系列新要求,迫切需要加強(qiáng)立法主體的立法能力建設(shè),不斷提高立法效率和立法質(zhì)量,為國家治理現(xiàn)代化提供更多的"良法"產(chǎn)品。立法能力是國家治理能力現(xiàn)代化的重要組成部分,是立法主體按照立法程序行使立法權(quán)力,通過立、改、廢、釋等方式提供立法產(chǎn)品,及時(shí)滿足經(jīng)濟(jì)社會(huì)文化發(fā)展對(duì)立法需要的一種能力。提高立法能力,一是應(yīng)當(dāng)暫停人大常委會(huì)目前實(shí)行的會(huì)期制,改為實(shí)行全年會(huì)期制,每天八小時(shí)坐班制;二是加快推進(jìn)人大常委的專職化、專業(yè)化、年輕化;三是推行立法助理制度,給人大常委全面配備立法助理;四是進(jìn)一步加強(qiáng)立法專業(yè)智庫建設(shè)。
[Abstract]:Since the 18th CPC Congress, China's legislative work has made remarkable achievements. However, under the new situation, the comprehensive deepening of the reform has put forward a series of new demands on the legislation. It is urgent to strengthen the legislative capacity of the main body of legislation, and to continuously improve the efficiency and quality of legislation. To provide more "good law" products for the modernization of national governance. Legislative capacity is an important part of the modernization of the national governance capacity. It is the main body of legislation that exercises its legislative power in accordance with the legislative procedures, and provides legislative products by means of legislation, reform, abolition, interpretation, and so on. Timely meet the economic, social and cultural development of the legislative needs of a capacity. First, we should suspend the current sessional system of the standing Committee of the National people's Congress (NPC) and switch to a year-round sessional system with eight hours of sitting hours a day; second, we should accelerate the promotion of the NPC standing Committee's full-time, professional, and young people; Third, implement the system of legislative assistants, and provide the NPC standing Committee with full legislative assistants; fourth, further strengthen the construction of legislative professional think tanks.
