【摘要】：布萊克借助對(duì)法律行為的定量分析構(gòu)建了"純粹法社會(huì)"理論體系。理論方面,他嘗試運(yùn)用一種嶄新的方法論去準(zhǔn)確地分析、預(yù)測(cè)法律現(xiàn)象的變化。實(shí)踐方面,布萊克倡導(dǎo)價(jià)值中立的法律判斷,主張司法應(yīng)當(dāng)致力于平等的對(duì)待每一個(gè)類似的案件。他將法律行為作為客觀的研究對(duì)象,運(yùn)用科學(xué)的方法將法律置于社會(huì)結(jié)構(gòu)中進(jìn)行分析。絕對(duì)客觀的分析方法使忽視了人的社會(huì)性,絕對(duì)的量化法律的分析過(guò)于機(jī)械化。全面的理解布萊克的行為理論對(duì)當(dāng)代中國(guó)法學(xué)研究具有重要意義。
[Abstract]:Blake constructed the theoretical system of "pure law society" with the help of quantitative analysis of legal behavior. In theory, he tried to use a new methodology to accurately analyze and predict changes in legal phenomena. In practice, Black advocates value-neutral legal judgment and argues that justice should be committed to equal treatment of every similar case. He regarded the legal act as the objective research object and analyzed the law in the social structure by the scientific method. The absolute objective analysis method neglects the sociality of human being, and the absolute quantitative law analysis is too mechanized. A comprehensive understanding of Black's theory of behavior is of great significance to the study of contemporary Chinese law.
