【摘要】：社會(huì)公權(quán)力乃公共權(quán)力之分支,與國(guó)家公權(quán)力相對(duì)應(yīng);其發(fā)端于社會(huì)內(nèi)部治理,是社會(huì)自治權(quán)的表征。政社分開與促進(jìn)社會(huì)組織建設(shè)是國(guó)家對(duì)公共治理提出的新命題,在國(guó)家與社會(huì)二元界分、政府與社會(huì)合作治理的新時(shí)代,社會(huì)公權(quán)力已然以一種新的權(quán)力形態(tài)凸顯于政治舞臺(tái)。該權(quán)力的運(yùn)行與組織建構(gòu)等均與國(guó)家公權(quán)力有著迥然不同的規(guī)則抑或規(guī)律;在自治與規(guī)制的良性和諧之間,在權(quán)力與權(quán)利的有效互動(dòng)之中,社會(huì)公權(quán)力與國(guó)家公權(quán)力一道演繹著多元民主與共建共治的新篇章。
[Abstract]:Social public power is a branch of public power, corresponding to the public power of the state; it originates in the internal governance of society and is the symbol of social autonomy. The separation of government and society and the promotion of social organization construction is a new proposition put forward by the state for public governance. In the new era of government and social cooperation and governance, the public power of society has been highlighted on the political stage with a new form of power. The operation and organizational construction of the power have different rules or laws from the public power of the state, and between the benign harmony of autonomy and regulation, the effective interaction between the power and the right. Social public power and state public power together deduce a new chapter of pluralistic democracy and co-establishment and co-governance.
