【摘要】：清末借鑒大陸法系進(jìn)行法律改革之前,屬于大陸法系的葡萄牙法已經(jīng)借助殖民管治東風(fēng),向澳門(mén)移植。鴉片戰(zhàn)爭(zhēng)后,葡萄牙單方面實(shí)施對(duì)澳門(mén)的殖民管治,最關(guān)鍵的是攫取清政府對(duì)澳門(mén)華人的管轄權(quán),尤其是司法管轄權(quán)。通過(guò)若干任澳葡總督的努力,葡萄牙逐步確立了對(duì)澳門(mén)華人的司法管治體制。基于詳實(shí)的葡文史料,梳理澳葡如何變通舊機(jī)構(gòu)以確立理事官署負(fù)責(zé)澳門(mén)華人司法管轄的原因、過(guò)程和變革細(xì)節(jié),并從葡萄牙法源頭追溯其如何移植適用于澳門(mén)。以此為例,豐富大陸法系于19世紀(jì)中葉在中國(guó)澳門(mén)的移植和司法實(shí)踐適用的認(rèn)識(shí)。
[Abstract]:Before the civil law system was reformed in the late Qing Dynasty, Portuguese law, which belonged to the civil law system, had been transplanted to Macao with the help of colonial rule. After the Opium War, Portugal unilaterally implemented the colonial rule over Macao, the most important thing was to seize the jurisdiction of the Qing government over Macao Chinese, especially the judicial jurisdiction. Through the efforts of several Macau-Portuguese governors, Portugal has gradually established a judicial governance system for Macao Chinese. Based on the detailed historical data of Portuguese, this paper combs the reasons, process and reform details of how Macao and Portugal have adapted the old institutions to establish the governing body responsible for the Chinese jurisdiction in Macao, and traces how it can be transplanted to Macao from the source of Portuguese law. Taking this as an example, it enriches the understanding of the transplantation of continental law system in Macao, China and the application of judicial practice in the middle of the 19th century.
