【摘要】：中國特色軍民融合法律體系是我國社會主義法治體系的重要組成部分。加快構(gòu)建中國特色軍民融合法律體系可以為加快提升國防實力和軍隊?wèi)?zhàn)斗力提供法治保障,為深化軍民融合創(chuàng)新發(fā)展奠定法治基礎(chǔ)。中國特色軍民融合法律體系建設(shè)應(yīng)當(dāng)與國家社會主義法律體系建設(shè)任務(wù)接軌,與中國特色軍事法律體系建設(shè)目標(biāo)銜接,與國防和軍隊建設(shè)對軍民融合法治化的需求相適應(yīng)。當(dāng)前,我國國防資源與社會資源的優(yōu)化配置存在法治缺失和實踐困境,軍民融合體制機制運轉(zhuǎn)存在深層矛盾,現(xiàn)有軍民融合法律制度架構(gòu)存在明顯弊端。加快構(gòu)建中國特色軍民融合法律體系要遵循四個原則,破除三個矛盾,強化軍民融合國家戰(zhàn)略的憲法基礎(chǔ),優(yōu)化頂層設(shè)計;消除體系分離的法律制度障礙,完善配套立法。同時,還要建立軍事需求管理法律制度和風(fēng)險評估法律制度,確保國防安全。
[Abstract]:The legal system of military and civil integration with Chinese characteristics is an important part of our socialist legal system. Speeding up the construction of the legal system of civil-military integration with Chinese characteristics can provide a legal guarantee for speeding up the enhancement of national defense strength and the combat effectiveness of the army, and lay a legal foundation for deepening the innovative development of military-civilian integration. The construction of the legal system of military and civil integration with Chinese characteristics should be in line with the task of building the socialist legal system of the state, the goal of the construction of the military legal system with Chinese characteristics, and the needs of the building of national defense and the army for the rule of law for the integration of military and civil affairs. At present, the optimal allocation of defense resources and social resources in our country is deficient in the rule of law and difficult in practice, there are deep contradictions in the operation of the system and mechanism of civil-military integration, and there are obvious drawbacks in the existing legal system of civil-military integration. To accelerate the construction of the legal system of civil-military integration with Chinese characteristics, we should follow four principles, break down the three contradictions, strengthen the constitutional basis of the national strategy of civil-military integration, optimize the top-level design, eliminate the barriers to the separation of the legal system and improve the supporting legislation. At the same time, it is necessary to establish a legal system of military demand management and a legal system of risk assessment to ensure the security of national defense.
