【摘要】：人類選擇了法律,便崇尚法律,但是人類法律文明的進步絕非是一蹴而就的,而是在眾多法哲學家的思想碰撞下逐漸地產(chǎn)生出一個又一個偉大的理論,從而推動了法律的進步和完善。從康德的法律價值絕對主義到新康德主義價值體系的誕生再到拉德布魯赫價值相對主義法哲學的最終構建,我們可以看出,在學術的領域之中,不存在絕對的“真理”,隨著社會經(jīng)濟的不斷發(fā)展和進步,人們總會不斷地發(fā)現(xiàn)新的方法、提出新的角度,于是原有的觀點不斷被挑戰(zhàn)、被完善、被推翻。而新觀點被廣泛接受前,往往會被看作是荒誕不經(jīng)的,要遭到嚴厲質(zhì)疑甚至無情打擊,歷盡千番曲折后才能慢慢被認同。價值相對主義法哲學的形成也同樣不可避免地經(jīng)歷了這翻曲折,從它的發(fā)展路徑過程中,我們可以領悟到,唯有在學術領域大力提倡百家爭鳴,對各家之見持海納百川的氣度,同時積極大膽地質(zhì)疑,這才是真正理性的態(tài)度,才有利于學術的繁榮,而這些正是我國法學乃至整個學術界所缺乏的學術品質(zhì)。因此,研究價值相對主義法哲學的發(fā)展路徑,不僅具有一定的理論意義,而且還具有極大的現(xiàn)實意義。本文主要分為三個部分： 第一部分主要論述了法律價值的絕對主義到相對主義的演變過程。從康德法哲學思想入手,著重對康德法哲學思想所體現(xiàn)的絕對性和超經(jīng)驗的普遍性、必然性進行論述,進而列舉了幾位具有代表性的哲學家對康德這種超現(xiàn)實的哲學思想所進行的批判和質(zhì)疑,而后到新康德主義的誕生,作為新康德主義西南學派的理論巨匠——拉德布魯赫,他在康德二元方法論以及新康德主義價值論的基礎之上開創(chuàng)了價值相對主義法哲學體系,就此,實現(xiàn)了法律價值的絕對主義向相對主義的飛躍。 第二部分在承接第一部分的基礎上,主要闡述了價值相對主義法哲學的演變原因及其取得的成就�？v觀歷史發(fā)展的背景以及西方學術界的發(fā)展態(tài)勢,筆者從必然因素和偶然因素兩方面來說明價值相對主義法哲學的演變原因,然后詳細論述了拉德布魯赫在其價值相對主義哲學上所取得的令人嘆服的偉大成就。 第三部分是本文的升華部分,通過思考價值相對主義法哲學發(fā)展路徑的整個過程,反思我國當代法學以及整個學術大環(huán)境的發(fā)展狀態(tài),從中吸取塑造中國當代法學獨立、包容的品格以及改善不良學術氛圍的有益之處。
[Abstract]:When human beings choose law, they advocate law, but the progress of human legal civilization is not achieved overnight, but gradually produces one great theory after another under the collision of many legal philosophers. Thus promoting the progress and improvement of the law. From Kant's legal value absolutism to the birth of Neo-Kant 's value system and to the final construction of Radbroch's value relativism, we can see that there is no absolute "truth" in the academic field. With the continuous development and progress of social economy, people always find new methods and put forward new angles, so the original views are constantly challenged, perfected and overturned. Before the new ideas are widely accepted, they are often regarded as absurd. They have to be severely questioned or even ruthlessly attacked before they can be accepted slowly after many ups and downs. The formation of the value relativism philosophy of law also inevitably experienced the twists and turns, from its development path process, we can understand that only in the academic field vigorously advocate a hundred schools of thought contend, and hold the tolerance of accepting all kinds of views from the sea. At the same time, it is the real rational attitude, which is beneficial to the academic prosperity, and these are the academic qualities that our law and even the whole academic circles lack. Therefore, the research on the development path of value relativism legal philosophy has not only theoretical significance, but also great practical significance. This paper is divided into three parts: the first part mainly discusses the evolution process from absolutism to relativism. From the view of Kant's philosophy of law, this paper discusses emphatically the absoluteness and the universality and inevitability of his philosophy of law. Then it enumerates several representative philosophers who criticize and question Kant's surreal philosophical thought, and then to the birth of Neo-Kantianism, as a theoretical giant of Neo-Kantianism Southwest School-Radbroch. On the basis of Kant's dual methodology and Neo-Kant 's value theory of value, he created the value relativism legal philosophy system, and thus realized the leap from absolutism of legal value to relativism. On the basis of the first part, the second part mainly expounds the evolution of the value relativism philosophy of law and its achievements. Looking at the background of historical development and the development trend of western academic circles, the author explains the evolution reason of value relativism legal philosophy from two aspects: inevitable factor and accidental factor. Then it discusses in detail the great achievements of Radbroch in his philosophy of value relativism. The third part is the sublimation part of this paper, through thinking about the whole process of the development path of the value relativism legal philosophy, reflecting the development state of our country's contemporary jurisprudence and the whole academic environment, and absorbing and shaping the independence of the Chinese contemporary law. Tolerance and the benefits of improving the academic atmosphere.
