【摘要】：改革開(kāi)放以來(lái),我國(guó)的經(jīng)濟(jì)建設(shè)取得了巨大的成就,法治建設(shè)也取得了長(zhǎng)足的進(jìn)步。但社會(huì)上仍舊存在很多不穩(wěn)定,不和諧的因素;部分改革中的遺留問(wèn)題沒(méi)有解決,發(fā)展中的新問(wèn)題又逐漸顯現(xiàn)出來(lái)。此時(shí)黨中央正式提出了“構(gòu)建社會(huì)主義和諧社會(huì)”的理念,這是及時(shí)而正確的。 作為中國(guó)傳統(tǒng)法律文化中獨(dú)具特色的一個(gè)組成部分,“和諧”歷來(lái)是人們孜孜追求的社會(huì)理想,是中華民族傳統(tǒng)文化的寶貴遺產(chǎn)。傳統(tǒng)社會(huì)中和諧的理念及其制度實(shí)踐,經(jīng)過(guò)數(shù)千年的緩慢演進(jìn)與完善,已經(jīng)深深植根于古代政治制度與社會(huì)生活的土壤中了。通過(guò)挖掘傳統(tǒng)法文化中的和諧價(jià)值理念及法律實(shí)踐精華,尋找這種理念的合理內(nèi)涵,考察古代社會(huì)長(zhǎng)治久安的原因,探尋法治發(fā)展的傳統(tǒng)動(dòng)力,必然有助于轉(zhuǎn)型期中國(guó)立法與司法的完善,為構(gòu)建和諧社會(huì)提供保障和借鑒。 本文從和諧社會(huì)建設(shè)的視角對(duì)傳統(tǒng)法律文化進(jìn)行考察,試圖通過(guò)發(fā)掘其中的和諧因素為今日的社會(huì)建設(shè)提供借鑒。本文第一部分對(duì)傳統(tǒng)法律文化的涵義進(jìn)行了分析,試著對(duì)其中蘊(yùn)含的和諧價(jià)值進(jìn)行闡釋。第二部分論述了和諧社會(huì)建設(shè)需要與之相適應(yīng)的法律文化支撐,需要法律文化的保障。第三部分主要介紹了傳統(tǒng)法律文化對(duì)和諧社會(huì)的啟示和價(jià)值,從思想和制度兩個(gè)方面進(jìn)行了分析。第四部分介紹了傳統(tǒng)法律文化可以借鑒的傳統(tǒng)資源,怎樣和現(xiàn)代社會(huì)治理相結(jié)合等。
[Abstract]:Since the reform and opening up, China's economic construction has made great achievements, the construction of the rule of law has also made considerable progress. However, there are still many unstable and disharmonious factors in society; some of the problems left over in the reform have not been solved, and new problems in development are gradually emerging. At this time, the CPC Central Committee formally put forward the concept of "building a socialist harmonious society", which is timely and correct. As a unique part of Chinese traditional legal culture, "harmony" has always been a social ideal pursued by people and a precious heritage of Chinese traditional culture. The idea of harmony in traditional society and its practice have been deeply rooted in the soil of ancient political system and social life after thousands of years of slow evolution and perfection. Through excavating the harmonious value idea and the essence of legal practice in the traditional law culture, the reasonable connotation of this idea is sought, the reason of the ancient society's lasting stability is investigated, and the traditional motive force of the development of the rule of law is explored. It will certainly help to perfect the legislation and judicature of China in the transition period and provide protection and reference for the construction of a harmonious society. This paper investigates the traditional legal culture from the perspective of the construction of a harmonious society, and tries to provide reference for the construction of today's society by exploring the harmonious factors. The first part of this paper analyzes the meaning of traditional legal culture and tries to explain the harmonious value. The second part discusses that the construction of harmonious society needs the support of legal culture and the guarantee of legal culture. The third part mainly introduces the enlightenment and value of the traditional legal culture to the harmonious society. The fourth part introduces the traditional resources which can be used for reference by the traditional legal culture, how to combine with the modern social governance and so on.
