【摘要】：作為一種維系社會(huì)轉(zhuǎn)型期秩序的政治意識(shí)形態(tài)和制度安排,"維穩(wěn)政治"雖然具有相當(dāng)?shù)默F(xiàn)實(shí)合理性,但其手段與目標(biāo)的背離導(dǎo)致了"越維穩(wěn)越不穩(wěn)"的困局。其根本原因在于維穩(wěn)思維與機(jī)制運(yùn)行本身落后于國(guó)家治理體系與治理能力現(xiàn)代化的要求,亦不能回應(yīng)社會(huì)實(shí)踐發(fā)展的需要。"法治中國(guó)"內(nèi)含著以法治思維為指導(dǎo)、以法律為依據(jù)、以維權(quán)達(dá)成法律秩序的目標(biāo)追求,為"維穩(wěn)政治"轉(zhuǎn)型提供了歷史契機(jī),"維穩(wěn)政治"向法治國(guó)家的轉(zhuǎn)變因而是建構(gòu)現(xiàn)代中國(guó)法治文明的必然選擇。
[Abstract]:As a kind of political ideology and institutional arrangement to maintain the order in the period of social transformation, "maintaining stable politics" has quite realistic rationality, but the deviation between its means and its goal leads to the dilemma of "the more stable the stability, the more unstable". The fundamental reason lies in the fact that the maintenance of stable thinking and the operation of the mechanism itself lags behind the requirements of the modernization of the country's governance system and governance capacity, and cannot respond to the needs of the development of social practice. " The rule of law in China contains the pursuit of the goal of legal order, which is guided by the thinking of the rule of law, based on the law and based on safeguarding the rights of the people. It provides a historical opportunity for the transformation of "maintenance and stability politics", and the transition from "maintenance politics" to "country ruled by law" is the inevitable choice to construct the civilization of rule of law in modern China.
