【摘要】：英國(guó)是世界社會(huì)法興起較早的國(guó)家之一,從《濟(jì)貧法》到《國(guó)民保險(xiǎn)法》,英國(guó)社會(huì)法興起的脈絡(luò)清晰,每一步的發(fā)展歷程都具有其歷史時(shí)代性的特點(diǎn),原創(chuàng)性強(qiáng),經(jīng)驗(yàn)及原理值得借鑒。本文首先以《濟(jì)貧法》到《國(guó)民保險(xiǎn)法》為線索進(jìn)行梳理,以觀察者的視角盡可能復(fù)原這一歷史時(shí)期英國(guó)社會(huì)法興起的原貌;其次,進(jìn)一步考察了從《濟(jì)貧法》到《國(guó)民保險(xiǎn)法》,影響英國(guó)社會(huì)法興起的因素,主要從背景、政府、思想三個(gè)方面展開(kāi)探析。再次,在梳理英國(guó)社會(huì)法興起的狀況、考察英國(guó)社會(huì)法興起影響因素的同時(shí),對(duì)英國(guó)社會(huì)法興起進(jìn)行簡(jiǎn)要概括分析其特點(diǎn),最后展開(kāi)經(jīng)驗(yàn)總結(jié)與啟示借鑒與挖掘。
[Abstract]:Britain is one of the countries with the early rise of social law in the world. From the Law of Poverty Relief to the Law of National Insurance, the context of the rise of British social law is clear, and the development of each step has its historical characteristics and originality. Experience and principle are worth drawing lessons from. In this paper, the author first combs the clue from the Law of Alleviation to the Law of National Insurance to restore as far as possible the original appearance of the rise of English social law in this historical period from the perspective of the observer. This paper further examines the factors that influence the rise of British social law from the Law of Poverty Relief to the Law of National Insurance, mainly from three aspects: background, government and thought. Thirdly, after combing the situation of the rise of English social law and investigating the influencing factors of the rise of British social law, the author briefly analyzes its characteristics, and finally carries out the experience summary, inspiration and excavation.
