【摘要】：中國(guó)古代家族法的產(chǎn)生,經(jīng)歷了一個(gè)漫長(zhǎng)的演進(jìn)歷程。由于歷史上各個(gè)時(shí)期的社會(huì)制度、法律制度與風(fēng)俗習(xí)慣的不同,我們要想弄清古代家族法的形成與發(fā)達(dá)的原因,需要深入細(xì)致地研究中國(guó)各個(gè)歷史時(shí)期家族制度的實(shí)際狀況。中國(guó)古代家族法以情、理、法為內(nèi)容,以無(wú)訟為追求,希冀達(dá)到和諧秩序的美好愿景,以此來(lái)維護(hù)家族的穩(wěn)定與團(tuán)結(jié)。中國(guó)古代家族法體現(xiàn)出政治、社會(huì)與經(jīng)濟(jì)三大功能,體現(xiàn)家與國(guó)的良性互動(dòng)。取其精華,去其糟粕,啟示我們要客觀地看待中國(guó)古代家族法,吸取合理的精神內(nèi)核,為我國(guó)和諧社會(huì)的構(gòu)建與精神文明建設(shè)服務(wù)。
[Abstract]:The generation of ancient Chinese family law has experienced a long process of evolution. Because of the difference of social system, legal system and custom in each period of history, if we want to find out the reason of the formation and development of ancient family law, we need to deeply and meticulously study the actual situation of family system in every historical period of China. In ancient China, the family law took emotion, reason and law as its content, pursued without litigation, and hoped to achieve the beautiful vision of harmonious order, so as to maintain the stability and unity of the family. The ancient Chinese family law embodied the three functions of politics, society and economy, and reflected the benign interaction between family and country. From the essence and the dross, we should treat the ancient Chinese family law objectively, absorb the reasonable spiritual core, and serve the construction of the harmonious society and the spiritual civilization in our country.
