【摘要】：明朝建立初期,政局尚未穩(wěn)定,經(jīng)濟遭到嚴重破壞,為強化中央集權,鞏固統(tǒng)治。朱元璋在吸取元朝覆亡教訓和總結歷朝吏治經(jīng)驗的基礎之上,再三思考之后,雷厲風行的推出了“重典”肅貪的策略。“重典”肅貪思想的形成并非偶然,有其深刻的歷史背景,更與朱元璋早年獨特的悲苦人生閱歷息息相關,使得朱元璋對官吏的貪墨行徑極其痛恨,因此其肅貪手段也極為野蠻和殘酷。朱元璋的采用的措施肅貪。第一,立重典,嚴懲貪腐。在制訂《大明律》、《大誥》以及其他榜文、條例的過程中始終貫穿重刑思想。第二,布監(jiān)察,強化預防。主要包括朝廷設立的監(jiān)察機關和鼓勵民眾檢舉揭發(fā)的監(jiān)督機制。第三,重教化,以德防貪。設立申明亭,教化百姓;官吏任選,注重品德;躬行垂范,以勤儉為美,為世人之表率。第四,嚴課考,優(yōu)勝劣汰。官吏考核,重在廉潔。第五,健全完善,官員回避制度。明代推行嚴格的回避制度,有效的抑制腐敗滋生。雖然肅貪沒有達到預期的效果,但在一定程度上肅清了吏治,達到了懲治貪腐行為的目的,在打擊豪強地主的同時,有效的緩解社會矛盾,客觀上為經(jīng)濟的發(fā)展提供了一個安穩(wěn)的環(huán)境。在對朱元璋“重典”肅貪法制的研究和探索,對我國當前嚴峻的反腐倡廉工作具有一定的借鑒意義和啟示。
[Abstract]:In the early days of the Ming Dynasty, the political situation was not stable and the economy was seriously damaged. On the basis of absorbing the lessons of the fall of the Yuan Dynasty and summing up the experience of the officials in the Yuan Dynasty, Zhu Yuanzhang put forward the strategy of "heavy Code" after thinking twice. The formation of the anti-corruption thought is not accidental, it has its profound historical background, and it is closely related to Zhu Yuanzhang's unique life experience in his early years, which makes Zhu Yuanzhang abhor the corrupt practices of government officials. Therefore, its means to combat corruption are also extremely brutal and cruel. Measures adopted by Zhu Yuanzhang to combat corruption. First, we should set up a solemn code and severely punish corruption. In the process of formulating the Daming Law, the Letters Patent and other articles, the thought of heavy punishment is always running through the process of the regulations. Second, the cloth monitors, strengthens the prevention. It mainly includes the supervisory organ set up by the court and the supervision mechanism to encourage the public to report and expose it. Third, we should pay more attention to education and prevent corruption by virtue. Set up declaration pavilion, educate the people; officials optional, pay attention to moral character; practice the model, to frugality for the United States, for the world to set an example. Fourth, strict examinations, survival of the fittest. Officials assessment, the emphasis is clean. Fifth, perfect and perfect the system of evading officials. In Ming Dynasty, strict avoidance system was carried out to effectively restrain corruption. Although anti-corruption has not achieved the desired results, to a certain extent, it has eliminated officials, achieved the goal of punishing corruption, and effectively alleviated social contradictions while cracking down on powerful landlords. Objectively, it provides a stable environment for economic development. The research and exploration of the anti-corruption law system of Zhu Yuanzhang "heavy Code" has certain reference significance and enlightenment to the serious anti-corruption work in our country at present.
