【摘要】：積極承擔(dān)社會責(zé)任已成為全球的共識,是各個行業(yè)、各個企業(yè)義不容辭的責(zé)任。目前,大多數(shù)企業(yè)已經(jīng)認識到承擔(dān)和履行社會責(zé)任對自身發(fā)展和社會發(fā)展的必要性和緊迫性。在國內(nèi),2008年先后發(fā)生的南方雪災(zāi)、5·12汶川地震、“三鹿事件”和國際金融危機引起了社會各界對“企業(yè)社會責(zé)任”前所未有的關(guān)注,承擔(dān)社會責(zé)任已經(jīng)成為我國企業(yè)生存發(fā)展的必修課。房地產(chǎn)行業(yè)作為帶動國民經(jīng)濟發(fā)展的支柱產(chǎn)業(yè),在房地產(chǎn)行業(yè)推行企業(yè)社會責(zé)任理念無疑會對以人為本的和諧社會的建設(shè)有著重大的促進作用。 本文以房地產(chǎn)企業(yè)為研究視角,針對房地產(chǎn)企業(yè)的特點及其存在的問題對房地產(chǎn)企業(yè)社會責(zé)任的法律規(guī)制進行探討。首先,以界定房地產(chǎn)企業(yè)范圍和企業(yè)社會責(zé)任的內(nèi)涵作為切入點對房地產(chǎn)企業(yè)社會責(zé)任的概念進行了概括;接著在分析房地產(chǎn)企業(yè)社會責(zé)任的特殊性的基礎(chǔ)上,論述了房地產(chǎn)企業(yè)在維護股東合法權(quán)益保障員工各項權(quán)利、依法納稅,落實國家宏觀調(diào)控政策、提供安全、舒適、價格合理的房屋和建筑、實施綠色節(jié)能開發(fā)等方面的社會責(zé)任內(nèi)容,并闡述了房地產(chǎn)企業(yè)承擔(dān)社會責(zé)任的必要性和意義。其次,針對目前我國房地產(chǎn)企業(yè)在消費者、員工、政府和環(huán)境方面承擔(dān)社會責(zé)任存在的問題,著重從企業(yè)社會責(zé)任意識不高,存在誤區(qū)、房地產(chǎn)市場信息不對稱、利益相關(guān)者維權(quán)意識低和成本高、行業(yè)協(xié)會作用有限以及評價和監(jiān)督體系滯后等五個方面剖析了問題產(chǎn)生的根源。再次,在我國企業(yè)社會責(zé)任立法概況的基礎(chǔ)上,分析了房地產(chǎn)企業(yè)社會責(zé)任法律規(guī)制存在的問題,如立法不完善、內(nèi)容可操作性差、內(nèi)容分散,整體協(xié)調(diào)性差,從加強立法、制定行業(yè)規(guī)范、完善相關(guān)制度等方面闡述了房地產(chǎn)企業(yè)履行社會責(zé)任的法律規(guī)制的完善途徑,對如何推動房地產(chǎn)企業(yè)積極履行社會責(zé)任進行初步探討。
[Abstract]:Taking active responsibility for social responsibility has become a global consensus. It is the responsibility of all industries and enterprises. At present, most enterprises have realized the necessity and urgency of carrying out and fulfilling social responsibility for their own development and social development. In China, the southern snow disaster occurred in 2008, the 5. 12 Wenchuan earthquake, and the "Sanlu Event" And the international financial crisis has aroused unprecedented attention from all walks of life to "corporate social responsibility", and social responsibility has become a compulsory course for the survival and development of enterprises in China. As a pillar industry to promote the development of national economy, the real estate industry will undoubtedly carry out the concept of corporate social responsibility in the real estate industry. The building of a harmonious society has an important role to promote.
This paper, taking the real estate enterprises as the research perspective, discusses the legal regulation of the social responsibility of real estate enterprises according to the characteristics and existing problems of real estate enterprises. First, the concept of the social responsibility of real estate enterprises is summarized by defining the scope of real estate enterprises and the connotation of corporate social responsibility. On the basis of the particularity of the social responsibility of the real estate enterprises, this paper expounds the social responsibility of the real estate enterprises in safeguarding the rights of the employees, paying taxes according to law, implementing the national macro-control policies, providing the safe, comfortable, reasonable price houses and buildings, and implementing the social responsibility in the development of Green Festival, and expounds the real estate. It is necessary and meaningful for the enterprise to bear social responsibility. Secondly, in view of the problems existing in the social responsibility of our real estate enterprises in the aspects of consumers, employees, government and the environment, the emphasis is on the poor awareness of the social responsibility of the enterprises, the misunderstanding, the asymmetric information of the real estate market, the low awareness of the rights of the stakeholders and the high cost, and the high cost of the interests of the stakeholders. The cause of the problem is analyzed in five aspects, such as the limited role of the association and the lag of the evaluation and supervision system. Thirdly, on the basis of the general situation of the social responsibility legislation of the enterprises in our country, the problems of the legal regulation of the social responsibility of the real estate enterprises are analyzed, such as the imperfect legislation, the poor content operation, the scattered content and the poor overall coordination. Strong legislation, the formulation of industry norms, and the improvement of relevant systems, such aspects as the real estate enterprises to fulfill the legal regulation of social responsibility, how to promote real estate enterprises to actively carry out social responsibility to carry out a preliminary discussion.
