【摘要】：對(duì)新法律現(xiàn)實(shí)主義之所以被提出的背景與意義的闡釋,離不開(kāi)對(duì)自20世紀(jì)二三十年代以來(lái)興起的舊法律現(xiàn)實(shí)主義、法律過(guò)程主義、批判法學(xué)、法社會(huì)學(xué)、法經(jīng)濟(jì)學(xué)等流派與運(yùn)動(dòng)的梳理。新法律現(xiàn)實(shí)主義不僅延續(xù)了舊法律現(xiàn)實(shí)主義對(duì)事實(shí)和開(kāi)放法學(xué)研究的提倡,還強(qiáng)調(diào)對(duì)已有的多學(xué)科方法研究成果的法律性重視,也呼吁其它學(xué)科的研究關(guān)注其研究的法律實(shí)質(zhì)意義。在其推動(dòng)下,傳統(tǒng)的法學(xué)研究和利用其它學(xué)科方法展開(kāi)的法學(xué)研究得以更好地滲透和合作,使得學(xué)科整合和實(shí)證法學(xué)研究更為有效地進(jìn)行。
[Abstract]:The explanation of the background and significance of the new legal realism is inseparable from the old legal realism, legal process doctrine, critical jurisprudence, and sociology of law which have arisen since the 1920s and 1930s. The carding of schools and movements of law and economics. New legal realism not only continues the advocacy of the old legal realism for the study of facts and open jurisprudence, but also emphasizes the legal importance attached to the research results of the existing multidisciplinary methods. It also appeals to other disciplines to pay attention to the legal significance of their research. Under its impetus, the traditional law research and the law research carried out by using other discipline methods can better infiltrate and cooperate, so that the subject integration and the empirical law research are carried out more effectively.
