【摘要】：公共規(guī)制必須通過(guò)市場(chǎng)主體行為的改變來(lái)發(fā)揮作用,因此公共規(guī)制能否取得預(yù)期效果取決于市場(chǎng)主體的行為選擇。市場(chǎng)主體可能采取的直接違法、制度規(guī)避、制度套利、共謀行為以及集體抗?fàn)幍刃袨?都會(huì)導(dǎo)致公共規(guī)制的有效性難以充分實(shí)現(xiàn)。市場(chǎng)主體的行為類型與市場(chǎng)主體的貼現(xiàn)率、市場(chǎng)主體對(duì)制度信息的可得性和可理解性、市場(chǎng)主體對(duì)公共規(guī)制的信任程度以及市場(chǎng)主體的自主性相關(guān)。以市場(chǎng)主體的可接受性為導(dǎo)向提升公共規(guī)制的有效性,應(yīng)通過(guò)提升公共規(guī)制的穩(wěn)定性品格、保證制度的制定和解釋能為市場(chǎng)主體所理解、提高公共規(guī)制的經(jīng)濟(jì)績(jī)效和公平相容性、重視激勵(lì)型規(guī)制等方面措施來(lái)實(shí)現(xiàn)。
[Abstract]:Public regulation must play a role by changing the behavior of the market subject, so whether the public regulation can achieve the expected effect depends on the behavior choice of the market subject. The direct violation of the law, system circumvention, institutional arbitrage, collusion and collective protest may lead to the effectiveness of public regulation difficult to be fully realized. The behavior type of market subject is related to the discount rate of market subject, the availability and comprehensibility of market subject to institutional information, the degree of trust of market subject to public regulation and the autonomy of market subject. To promote the effectiveness of public regulation under the guidance of the acceptability of market subjects, we should promote the stability of public regulation and ensure that the formulation and interpretation of the system can be understood by market subjects. Improve the economic performance and fair compatibility of public regulation, pay attention to incentive regulation and other measures to achieve.
