【摘要】：在生物樣本庫管理過程中,由于生物樣本包含個人獨特的生物信息,可能具有巨大的經(jīng)濟價值,生物樣本的所有權(quán)可能成為捐贈者的關(guān)切,可派生出相關(guān)的知情同意、專利收益和不當?shù)美麊栴}。對此,美國案例法提示我們,生物樣本捐贈者的同意捐贈,應當是被充分告知和知情的,強調(diào)明示的知情同意;生物樣本庫產(chǎn)權(quán)單位,應當建立相關(guān)專利的權(quán)屬歸其所有的知識產(chǎn)權(quán)政策;在與研究者和捐贈者的關(guān)系中,要求生物樣本庫產(chǎn)權(quán)單位明確實現(xiàn)利益分享的條件。這些規(guī)則,對于包括國家基因庫在內(nèi)的我國生物樣本庫的倫理和法制建設,具有啟示意義和借鑒價值。
[Abstract]:In the management of biological sample banks, because biological samples contain individual unique biological information and can be of great economic value, the ownership of biological samples may become a donor's concern and derive relevant informed consent, Patent income and improper enrichment. In this regard, the case law of the United States reminds us that the consent of a biological sample donor should be fully informed and informed, emphasizing explicit informed consent; the unit of property rights in the biological sample bank, The intellectual property policy should be established for the ownership of the relevant patents; in the relations with researchers and donors, the property rights unit of the biological sample bank should be required to define the conditions for the realization of benefit-sharing. These rules have enlightening significance and reference value for the construction of ethics and legal system of biological sample bank in China including the national gene bank.
