《史密斯—蒙特法》及其修正案研究

【摘要】:本文將要研究的是《史密斯-蒙特法》及其修正案。《史密斯-蒙特法》即《美國(guó)1948年信息與教育交流法》,該法對(duì)美國(guó)對(duì)外信息、教育與文化交流曾經(jīng)發(fā)生并繼續(xù)發(fā)生著重大影響,具有十分重要的歷史研究?jī)r(jià)值和現(xiàn)實(shí)意義。本文是在對(duì)《史密斯-蒙特法》及其修正案出臺(tái)背景、過(guò)程、內(nèi)容及其影響和價(jià)值研究的基礎(chǔ)上,分析和認(rèn)識(shí)美國(guó)公共外交或者說(shuō)文化外交問(wèn)題。對(duì)外教育與文化交流是美國(guó)外交的重要內(nèi)容之一,并取得了重大的收獲和成果,但是,該法還存在許多問(wèn)題,引起了美國(guó)各界的爭(zhēng)論一直延續(xù)至今。其他國(guó)家學(xué)者也對(duì)該法提出許多異議,諸如在美國(guó)的訪問(wèn)學(xué)者必須離開(kāi)美國(guó)2年以后才允許移民美國(guó)的問(wèn)題、美國(guó)對(duì)外宣傳的信息不可以在美國(guó)進(jìn)行宣傳的問(wèn)題等等。對(duì)這些問(wèn)題的研究是本文的主要內(nèi)容。文章序言部分說(shuō)明筆者的選題依據(jù)、該課題研究的學(xué)科價(jià)值、現(xiàn)實(shí)意義、國(guó)內(nèi)外研究現(xiàn)狀、研究方法和步驟等。第一章介紹《史密斯-蒙特法》出臺(tái)的背景,包括美國(guó)早期、與拉丁美洲國(guó)家和二戰(zhàn)前后的對(duì)外信息、教育與文化交流活動(dòng),并說(shuō)明這些活動(dòng)對(duì)后來(lái)《史密斯-蒙特法》的出臺(tái)具有哪些影響。第二章介紹《史密斯-蒙特法》出臺(tái)過(guò)程和內(nèi)容分析,包括1945-1947年和1947-1948年國(guó)會(huì)的立法過(guò)程、《史密斯-蒙特法》的主要內(nèi)容、筆者對(duì)該法的分析。第三章介紹《史密斯-蒙特法》的修正案,包括1956、1961.1972.1985、1990和2012年的多次修正,并說(shuō)明這些修正的主要內(nèi)容涉及對(duì)外宣傳的材料不可以在美國(guó)國(guó)內(nèi)傳播的問(wèn)題、總統(tǒng)權(quán)力問(wèn)題、對(duì)訪問(wèn)美國(guó)的學(xué)者離開(kāi)美國(guó)兩年方可移民美國(guó)的期限問(wèn)題等等。第四章對(duì)《史密斯-蒙特法》及其修正案進(jìn)行評(píng)價(jià),包括法理原則、教育為本、國(guó)會(huì)立法和完備的監(jiān)督機(jī)制、非政府組織和公民個(gè)人活動(dòng)納入國(guó)家文化戰(zhàn)略等等。本文結(jié)語(yǔ)部分對(duì)《史密斯-蒙特法》修正案出臺(tái)的背景和原因、該法對(duì)美國(guó)文化外交的意義等問(wèn)題進(jìn)行了分析。本文附錄中是《史密斯-蒙特法》的中英文文本。
[Abstract]:This article is going to study the Smithsonian Act and its amendments. The Smithsonian Act is the Information and Education Exchange Act of 1948, which provides foreign information to the United States. Education and cultural exchanges have had and continue to have a significant impact, which has very important historical research value and practical significance. Based on the background, process, content, influence and value of the Smithsonian Act and its amendments, this paper analyzes and understands the problems of American public diplomacy or cultural diplomacy. Foreign education and cultural exchange is one of the important contents of American diplomacy, and it has made great achievements and achievements. However, there are still many problems in this law, which has caused the controversy of all circles in the United States to last until now. Scholars from other countries have also raised many objections to the law, such as the issue that visiting scholars in the United States have to leave the United States for two years before they can immigrate to the United States, and the issue that the information propagated abroad by the United States cannot be propagated in the United States, and so on. The study of these problems is the main content of this paper. The preface of the article explains the author's basis of selecting the subject, the subject value, practical significance, domestic and foreign research status, research methods and steps. The first chapter introduces the background of the Smiths-Monterey Act, including the information, education and cultural exchanges between the United States and Latin American countries and before and after World War II. The influence of these activities on the introduction of the Smithsonian Act is explained. The second chapter introduces the process and content analysis of the Smithsonian Act, including the legislative process of Congress from 1945-1947 and 1947-1948, and the main contents of the Smiths-Monte Act, and the author's analysis of the Act. Chapter III introduces the amendments to the Smithsonian Act, including several amendments in 1956 / 1961.1972.1985 / 1990 and 2012, and states that the main elements of these amendments relate to the issue of the non-dissemination of publicizing materials in the United States and the question of the power of the President, The time limit for visiting American scholars to leave the United States for two years before immigrating to the United States, etc. The fourth chapter evaluates the Smithsonian Act and its amendments, including the principles of jurisprudence, education-oriented, congressional legislation and a complete monitoring mechanism, and the incorporation of non-governmental organizations and individual citizen activities into the national cultural strategy, and so on. The last part of this paper analyzes the background and reasons of the amendment of the Smithsonian Act and the significance of the Act to American cultural diplomacy. The appendix to this article is the English and Chinese versions of the Smithsonian Act.
