【摘要】：在依法治國理念下去建設社會主義現(xiàn)代化國家過程中,存在著法治與德治如何有機結(jié)合的問題。一個國家法治的良好運行離不開道德的約束,然而在道德的選擇上也會面臨一系列的困境。本文從法治實踐中所遇到的困境入手,闡述了法治實踐中道德困境的內(nèi)涵及類型,法治實踐中道德困境所具有的表現(xiàn)以及出現(xiàn)這些現(xiàn)象的原因,針對法治實踐中道德困境的現(xiàn)狀,分別從立法活動主體、執(zhí)法活動主體、司法活動主體以及守法活動主體入手尋找走出道德困境的對策,這對于更好地實踐法治有著重要的現(xiàn)實意義。文章共分為四個部分,第一部分為緒論,主要包括研究目的與意義,研究動態(tài)與本論題的新意以及研究方法;第二部分為法治實踐中道德困境的內(nèi)涵及其類型,以法治實踐中遇到的道德困境為出發(fā)點,對其內(nèi)涵,類型進行了概述;第三部分為法治實踐中道德困境的表現(xiàn)及其成因,分別描述了法治實踐中所呈現(xiàn)的的合法不合理和合理不合法的道德困境以及造成現(xiàn)在這些困境的原因。第四部分為走出法治實踐中道德困境的對策,分別從立法活動主體,執(zhí)法活動主體,司法活動主體以及守法活動主體入手,提出解決這一困境的對策。
[Abstract]:In the process of building a modern socialist country with the idea of governing the country according to law, there exists the problem of how to combine the rule of law with the rule of virtue.The good operation of a country's rule of law can not be separated from the restriction of morality. However, the choice of morality will also face a series of dilemmas.Starting with the difficulties encountered in the practice of rule of law, this paper expounds the connotation and types of moral dilemmas in the practice of rule of law, the performance of moral dilemmas in practice of rule of law and the reasons for these phenomena.In view of the current situation of moral dilemma in the practice of rule of law, the author tries to find out the countermeasures from the main body of legislative activity, the subject of law enforcement activity, the subject of judicial activity and the subject of law-abiding activity respectively.This has important practical significance for the better practice of the rule of law.The article is divided into four parts, the first part is the introduction, including the research purpose and significance, the research trends, the new ideas of this topic and the research methods, the second part is the connotation and types of moral dilemma in the practice of rule of law.Based on the moral dilemma encountered in the practice of the rule of law as the starting point, this paper summarizes its connotation and types, the third part is the expression of the moral dilemma in the practice of the rule of law and its causes.It describes the legal unreasonable and reasonable illegal moral dilemmas presented in the practice of the rule of law and the causes of these dilemmas.The fourth part is to get out of the moral dilemma in the practice of the rule of law, respectively from the legislative activities of the main body, law enforcement activities, judicial activities and law-abiding activities of the main body, put forward the solution to this dilemma countermeasures.
