【摘要】：中國公開征集立法項(xiàng)目建議已從實(shí)踐逐步走向制度化,在踐行這一民主、科學(xué)立法決策的重要實(shí)踐中,立法機(jī)關(guān)已經(jīng)獲得了一些有益經(jīng)驗(yàn),但也存在良好實(shí)踐難以穩(wěn)定持續(xù)推進(jìn)、參與權(quán)利缺乏制度保障、信息公開相對(duì)不暢以及反饋機(jī)制有待健全等缺憾。與中國相關(guān)實(shí)踐與制度形成鮮明對(duì)比的是,國外一些征集建議主體能夠主動(dòng)公開立法背景資料、構(gòu)建并實(shí)際運(yùn)作征集意見專業(yè)網(wǎng)絡(luò)平臺(tái)、積極推進(jìn)公民參與立法教育和培訓(xùn),甚至已形成了適度限制征集建議使用范圍的理念�？偨Y(jié)和借鑒這些對(duì)比性經(jīng)驗(yàn),中國有必要考慮采取健全公開征集立法項(xiàng)目建議制度、深化立法信息公開制度、提升公眾的立法參與能力、完善溝通交涉以及反饋機(jī)制等措施,以科學(xué)、合理地解決中國當(dāng)前的制度與實(shí)踐問題。
[Abstract]:China's open solicitation of legislative proposals has gradually moved from practice to institutionalization. In the practice of this important practice of democracy and scientific legislative decision-making, the legislature has gained some useful experience.However, there are some shortcomings such as the difficulty of steady and continuous promotion of good practice, the lack of institutional protection of the right to participate, the relative unobstructed information disclosure and the lack of sound feedback mechanism.In contrast to the relevant practice and system in China, some foreign solicitation and suggestion subjects can actively open the legislative background information, construct and actually operate the professional network platform for soliciting opinions, and actively promote citizens' participation in legislative education and training.It has even formed the idea of moderately limiting the scope of use of proposals for solicitation.To sum up and draw lessons from these comparative experiences, it is necessary for China to consider such measures as improving the proposal system for open solicitation of legislative projects, deepening the system of publicity of legislative information, enhancing the public's ability to participate in legislation, and perfecting communication, negotiation and feedback mechanisms.Scientific and reasonable solutions to China's current system and practice.
