【摘要】：陜甘寧邊區(qū)的司法制度作為新中國司法的制度性法源,一直為學(xué)界所關(guān)注,但對(duì)其歷史地位和現(xiàn)實(shí)意義,卻呈現(xiàn)出兩極化的評(píng)價(jià)。本文運(yùn)用"語境論"的法律制度研究方法,以邊區(qū)司法制度的典型——馬錫五審判方式為例進(jìn)行多維度分析,強(qiáng)調(diào)要?dú)v史地辯證地看待馬錫五審判方式的地位和作用。如此,才能對(duì)馬錫五審判方式及其代表的邊區(qū)司法制度的歷史地位作出符合"當(dāng)時(shí)語境"、客觀公正的認(rèn)識(shí)和評(píng)價(jià)。
[Abstract]:The judicial system of the Shensi-Kansu-Ningsia Border region, as the institutional source of justice in New China, has always been concerned by the academic circles, but its historical status and practical significance show a polarized evaluation.In this paper, the author uses the research method of legal system of "context theory", taking the typical judicial system of the border region-Ma Xi-wu as an example to carry on the multi-dimensional analysis, and emphasizes that the position and function of Ma Xi-wu 's trial mode should be viewed dialectically in history.Only in this way can we make an objective and fair understanding and evaluation of the judicial system of Ma Xi-wu and its representative judicial system in accordance with the "context at that time".
