【摘要】：本文主要以羅爾斯的《正義論》為研究對(duì)象,旨在梳理和探討其中羅爾斯的程序正義論。 羅爾斯在《正義論》中,有關(guān)程序正義最直接的內(nèi)容,是將程序正義分為純粹的程序正義、完善的程序正義、不完善的程序正義三類,程序正義的論述更多的是間接體現(xiàn)在以純粹的程序正義為核心的程序正義的證明與運(yùn)用過程中。本文以羅爾斯從對(duì)程序正義直接和間接論述的兩個(gè)方面來分析羅爾斯的程序正義,并分析羅爾斯純粹的程序正義設(shè)計(jì)以及所體現(xiàn)的程序本身的內(nèi)在價(jià)值——程序正義。 本文共分為三部分,第一部分：羅爾斯程序正義論形成的背景及淵源。為了更好的探討羅爾斯程序正義論的內(nèi)容,本部分從橫縱兩個(gè)緯度來說明羅爾斯程序正義論的形成。橫向是羅爾斯提出程序正義的《正義論》產(chǎn)生的背景,包括羅爾斯正義思想形成的個(gè)人成長(zhǎng)背景和羅爾斯所處社會(huì)的時(shí)代背景�？v向是羅爾斯程序正義論形成的歷史淵源,包括英國的“自然正義”、美國的“正當(dāng)法律程序”和歐洲大陸其他國家的程序正義觀念三個(gè)方面。 第二部分：羅爾斯程序正義論之分析。本部分主要系統(tǒng)的分析羅爾斯程序正義論的內(nèi)容。以羅爾斯《正義論》到《政治自由主義》為主線,首先論述羅爾斯在《正義論》當(dāng)中對(duì)程序正義的三種分類：純粹的程序正義、完善的程序正義、不完善的程序正義,以及筆者對(duì)羅爾斯程序正義論之解讀。其次論述羅爾斯在《政治自由主義》中對(duì)程序正義的修正,引入實(shí)體正義并提出重疊一致的概念。《正義論》中純粹的程序正義是羅爾斯程序正義的核心,而羅爾斯的兩個(gè)正義原則是《正義論》的核心和重點(diǎn),是指導(dǎo)社會(huì)的基本結(jié)構(gòu)建立的正義原則,“純粹的程序正義是證成兩個(gè)正義原則的渠道和方式”,接下來筆者將分析羅爾斯是如何通過設(shè)計(jì)純粹的程序正義來論證兩個(gè)正義原則是“迄今為止最好的正義原則”。最后筆者從價(jià)值的獨(dú)立性、對(duì)人的尊重、普遍的結(jié)果認(rèn)同三個(gè)方面來談?wù)劻_爾斯純粹的程序正義所體現(xiàn)的程序正義價(jià)值。 第三部分：羅爾斯程序正義論之評(píng)析。自羅爾斯發(fā)表《正義論》一書以來,有關(guān)程序正義的理論和學(xué)說不斷出現(xiàn),有對(duì)羅爾斯積極的回應(yīng),也有對(duì)羅爾斯強(qiáng)烈的批評(píng)和質(zhì)疑。本部分首先論述羅爾斯程序正義論的理論意義,然后分析眾多學(xué)者對(duì)羅爾斯程序正義論的質(zhì)疑。羅爾斯對(duì)程序正義的論述不僅對(duì)英美法系產(chǎn)生了深遠(yuǎn)的影響,同時(shí),也引領(lǐng)了大陸法系國家諸如法、德等國對(duì)程序正義問題的深入探討,鑒于中國歷來有重實(shí)體,輕程序的傳統(tǒng),最后筆者談?wù)劻_爾斯程序正義論對(duì)我國的幾點(diǎn)借鑒意義。 本文主要采用了歷史分析、比較分析、法律解釋等方法進(jìn)行研究。
[Abstract]:This paper focuses on Rawls' Theory of Justice, which aims to sort out and discuss Rawls' theory of procedural justice.In the Theory of Justice, Rawls divides procedural justice into three categories: pure procedural justice, perfect procedural justice and imperfect procedural justice.The discussion of procedural justice is indirectly reflected in the proof and application of procedural justice with pure procedural justice as its core.This paper analyzes Rawls' procedural justice from the two aspects of direct and indirect discussion of procedural justice, and analyzes Rawls' pure procedural justice design as well as the inherent value of the procedure itself-procedural justice.This paper is divided into three parts. The first part: the background and origin of Rawls' procedural justice theory.In order to better discuss the content of Rawls' procedural justice theory, this part explains the formation of Rawls' procedural justice theory from two latitudes.Horizontal is the background in which Rawls put forward the theory of procedural justice, including the background of personal growth of Rawls' thought of justice and the background of the era of Rawls' society.Vertical is the historical origin of Rawls' theory of procedural justice, including "natural justice" in Britain, "due process" in the United States and the concept of procedural justice in other countries in continental Europe.The second part: the analysis of Rawls' theory of procedural justice.This part systematically analyzes the content of Rawls' procedural justice theory.Taking Rawls' Theory of Justice to political Liberalism as the main line, this paper first discusses three kinds of classification of procedural justice in Rawls' Theory of Justice: pure procedural justice, perfect procedural justice, imperfect procedural justice.And the author's interpretation of Rawls's theory of procedural justice.Secondly, it discusses Rawls' revision of procedural justice in political liberalism, introduces substantive justice and puts forward the concept of overlapping consistency. The pure procedural justice in < Justice > is the core of Rawls' procedural justice.The two principles of justice of Rawls are the core and the focus of the theory of justice, and they are the principles of justice that guide the establishment of the basic structure of the society. "the pure procedural justice is the channel and the way to prove the two principles of justice".Then the author will analyze how Rawls designs pure procedural justice to prove that the two principles of justice are "the best principle of justice so far".Finally, the author discusses the value of procedural justice embodied by Rawls' pure procedural justice from three aspects: the independence of value, respect for human beings, and universal result identification.The third part: the analysis of Rawls' theory of procedural justice.Since Rawls published the Theory of Justice, the theories and theories of procedural justice have appeared constantly, there are positive responses to Rawls, and there are also strong criticisms and doubts against Rawls.This part first discusses the theoretical significance of Rawls' theory of procedural justice, and then analyzes many scholars' doubts about Rawls' theory of procedural justice.Rawls' exposition on procedural justice not only had a profound influence on the common law system, but also led countries such as law, Germany and other countries in the continental law system to probe deeply into the problem of procedural justice, in view of the fact that China has always attached great importance to the substance.In the end, the author talks about the reference meaning of Rawls' procedural justice theory to our country.This paper mainly adopts historical analysis, comparative analysis, legal interpretation and other methods to study.
