【摘要】：現(xiàn)代法治注重程序法控權。我國相關法律關于行政立法程序的規(guī)定,相比以往,在程序的可行性和民主性兩個方面都有所發(fā)展,特別是體現(xiàn)行政立法民主的公眾參與機制在規(guī)范和實踐層而都發(fā)展迅速。然而,現(xiàn)行行政立法程序在確保立法質(zhì)量和立法公正方而,與應然層面相比較,與日益增長的公眾對參與立法的利益訴求相比較,仍然存在很大差距。本文的日的在于通過介紹和評論中美兩國在行政立法程序方面的理論與實踐框架,展現(xiàn)兩國在行政立法領域公眾參與的樣態(tài)。美國的行政立法程序以《聯(lián)邦行政程序法》為核心規(guī)范,其行政立法程序是較為完備和詳細的。在立法動議、立法信息公開、立法聽證等環(huán)節(jié),其許多做法值得我們借鑒。
[Abstract]:Modern rule of law pays attention to the control of procedural law.Compared with the past, the relevant laws of our country have developed in both the feasibility and the democracy of the procedure, especially the mechanism of public participation, which embodies the democracy of the administrative legislation, has developed rapidly in both the normative and practical levels.However, there is still a big gap between the current administrative and legislative procedures in ensuring the quality and fairness of legislation, in comparison with the level of necessity, and in comparison with the growing interest demands of the public to participate in the legislation.The purpose of this paper is to show the public participation in the field of administrative legislation by introducing and commenting on the theoretical and practical framework of administrative and legislative procedures between China and the United States.The administrative and legislative procedure in the United States is based on the Federal Administrative procedure Act, and its administrative and legislative procedure is relatively complete and detailed.In legislative motions, legislative information publicity, legislative hearings and other links, many of its practices are worthy of our reference.
