【摘要】：正德國思想家康德在《實(shí)踐理性批判》一書中寫道:"有兩樣?xùn)|西,越是經(jīng)常而持久地對它們進(jìn)行反復(fù)思考,它們就越使心靈充滿常新而日益增長的驚贊和敬畏:在我頭上的星空和我心中的道德法則。"(1)每逢品讀自己鐘愛的這段格言,總不免懷想:倘若道德與法律之間并非一些人所宣稱的"上帝歸上帝,愷撒歸愷撒"那么簡單,法律中的道德孕育將會(huì)成就怎樣的圖景,那行地江河、同輝日月的崇高道德法則,又將如何引領(lǐng)人們通往良法善治之路?
[Abstract]:Kant, the German thinker, wrote in his critique of practical reason: "there are two things that the more often and continuously think about them,The more they fill the heart with new and growing admiration and awe: the starry sky above my head and the moral law in my heart.I can't help but wonder: if the relationship between morality and law is not as simple as some claim, "God is God, Caesar is Caesar", what kind of picture will be achieved by moral gestation in the law?How will the lofty moral principles of the sun and moon lead people to the path of good law and good governance?
