【摘要】：2015年初上海市商務(wù)委員會(huì)發(fā)布的《關(guān)于在中國(上海)自由貿(mào)易試驗(yàn)區(qū)開展平行進(jìn)口汽車試點(diǎn)的通知》中首次以公開的形式給予了平行進(jìn)口汽車合法的地位,也使得長期處在"灰色地帶"的平行進(jìn)口汽車正式合法化。筆者認(rèn)為,平行進(jìn)口汽車的放開對于我國發(fā)展是利大于弊的,對于其售后服務(wù)的缺失、安全性測試與"3C"標(biāo)準(zhǔn)不符等問題則應(yīng)通過設(shè)立相關(guān)制度予以規(guī)范。這樣既符合我國當(dāng)前經(jīng)濟(jì)發(fā)展的需要也契合了自貿(mào)區(qū)推進(jìn)制度創(chuàng)新的理念,同時(shí)也有望借此機(jī)會(huì)完善我國在商標(biāo)平行進(jìn)口立法方面的空白,對多個(gè)領(lǐng)域都將產(chǎn)生深遠(yuǎn)的影響。
[Abstract]:The notice issued by the Shanghai Municipal Commerce Commission in early 2015 on the pilot of parallel imported cars in China's (Shanghai) Free Trade Test Zone was the first to give legal status to parallel imported vehicles in an open form.It also legalizes parallel-imported cars that have long been in the grey zone.The author holds that the liberalization of parallel imported vehicles is more beneficial than harmful to the development of our country, and the problems of its lack of after-sales service, the discrepancy between safety test and "3C" standard should be standardized by establishing relevant system.This is not only in line with the needs of our current economic development, but also in line with the concept of promoting institutional innovation in the Free Trade Zone. At the same time, it is expected to take this opportunity to perfect the blank in the legislation of trademark parallel import in China, which will have a far-reaching impact on many fields.
