【摘要】：我國社會主義市場經(jīng)濟(jì)體制的建立,對我國社會的各個方面帶來了深刻而復(fù)雜的變化,原有的計劃經(jīng)濟(jì)體制下掩蓋的各種社會問題逐漸凸顯出來。弱勢群體的存在自改革開放以來,由于市場經(jīng)濟(jì)的發(fā)展所引發(fā)的社會分層結(jié)構(gòu)性調(diào)整,使其造成的社會影響問題日趨明顯。社會弱勢群體問題成為政府部門重點解決的焦點問題,也成為社會學(xué)、經(jīng)濟(jì)學(xué)、政治學(xué)、法學(xué)等諸多學(xué)科研究的熱點。如何保護(hù)弱勢群體的權(quán)益,怎樣減少弱勢人群產(chǎn)生,成為社會主義發(fā)展進(jìn)程中的重要課題,影響著社會的穩(wěn)定和經(jīng)濟(jì)的發(fā)展。弱勢群體的存在,已經(jīng)演變成不可忽視的社會性問題,弱勢群體作為一個特殊的群體,他們的權(quán)利因為自身、自然或社會因素而弱化,要實現(xiàn)法律對弱勢群體的保護(hù)功能,就應(yīng)當(dāng)在承認(rèn)弱勢群體權(quán)利弱化這種特殊性的基礎(chǔ)上,對其進(jìn)行設(shè)計傾斜性的制度,尤其要設(shè)計特別的救濟(jì)途徑來實現(xiàn)對弱勢群體的增權(quán)。 對社會弱勢群體的保護(hù)是對社會中的人的保護(hù),目的是人的全面自由發(fā)展,對社會弱勢群體的保護(hù)有助于解決不斷增長的人口壓力和日趨減少的自然資源的矛盾的緩解,對社會弱勢群體進(jìn)行保護(hù),調(diào)整強(qiáng)勢、弱勢群體間的利益關(guān)系,使社會關(guān)系更加和諧。作者認(rèn)為,弱勢群體保護(hù)問題的解決途徑,應(yīng)當(dāng)在運用社會學(xué)方法分析的基礎(chǔ)上,探究其成因,再運用法學(xué)的理論將其細(xì)化解決,從而建立一套由靜態(tài)立法體系和動態(tài)法治系統(tǒng)相結(jié)合的法律保護(hù)系統(tǒng),才能使社會弱勢群體獲得持之以恒、行之有效的保護(hù)。 本文首先分析當(dāng)下中國弱勢群體問題的形成原因,以社會性原因造成的弱勢群體為主要討論對象,從法社會學(xué)的視角,通過綜合運用社會調(diào)查及分析與推理等方法,結(jié)合對中國弱勢群體權(quán)利保護(hù)的現(xiàn)狀分析,再對弱勢群體保護(hù)的理論基礎(chǔ)和法律原則及措施進(jìn)行探討。從而試圖建立一套法律與制度體系結(jié)合的法律保護(hù)系統(tǒng),從政府扶持、社會幫助以及弱勢群體自身的意識提高等角度,保護(hù)弱勢群體權(quán)益,從根本上解決弱勢群體的弱勢,達(dá)到權(quán)利補(bǔ)強(qiáng),地位平等的目的。
[Abstract]:The establishment of our socialist market economy system has brought profound and complex changes to all aspects of our society. The various social problems concealed under the original planned economy system have gradually become prominent. Since the reform and opening up to the outside world, the social stratification and structural adjustment caused by the development of the market economy has resulted from the existence of the vulnerable groups. The problem of social impact is becoming more and more obvious. The problem of social vulnerable groups has become the focus of government departments, and it has also become the focus of sociology, economics, political science, How to protect the rights and interests of vulnerable groups, how to reduce the generation of vulnerable groups, become an important subject in the process of socialist development, affect the social stability and economic development, and the existence of vulnerable groups. As a special group, the rights of vulnerable groups are weakened because of their own, natural or social factors. On the basis of recognizing the weakness of the rights of the vulnerable groups, we should design the system of inclination, especially the special relief ways to realize the empowerment of the vulnerable groups. The protection of the vulnerable groups of society is the protection of the human beings in the society, with the aim of the full and free development of human beings, and the protection of the vulnerable groups of the society can help to alleviate the contradictions between the growing population pressure and the diminishing natural resources, The author thinks that the solution to the problem of the protection of the vulnerable groups should be based on the sociological analysis. To probe into the causes of its formation, and then to use the theory of law to refine and solve it, and thus to establish a legal protection system which combines the static legislative system and the dynamic legal system, can make the vulnerable groups of the society persevere and be effectively protected. This paper first analyzes the causes of the formation of the problem of the vulnerable groups in China, taking the vulnerable groups caused by social reasons as the main discussion object, from the perspective of sociology of law, through the comprehensive use of social investigation, analysis and reasoning methods. Based on the analysis of the current situation of the protection of the rights of the vulnerable groups in China, this paper probes into the theoretical basis and the legal principles and measures of the protection of the vulnerable groups. In order to protect the rights and interests of the vulnerable groups, the social help and the awareness of the vulnerable groups should be improved, so as to solve the weakness of the vulnerable groups fundamentally and to achieve the goal of strengthening the rights and equal status.
