【摘要】：為解決由于部門利益之爭而導致的立法久拖不決現(xiàn)象,有必要對重要立法事項引入第三方評估制度。第三方評估的主體應當由具有專業(yè)性、中立性、公信力的機構(gòu)擔任,可以建立第三方評估機構(gòu)信息庫。當出現(xiàn)重要立法事項且因部門利益而產(chǎn)生爭議時,立法決策機關(guān)或爭議雙方可委托第三方評估機構(gòu)對之進行評估。第三方評估機構(gòu)按照一定的評估程序,在與各方協(xié)商的基礎(chǔ)上作出公正的評估報告。評估報告應轉(zhuǎn)化為立法決策機關(guān)的決定,作為立法決策的重要依據(jù)。
[Abstract]:In order to solve the problem of legislation procrastination, it is necessary to introduce the third-party evaluation system into important legislative matters. The main body of third-party evaluation should be specialized, neutral and credible organizations. A third party evaluation agency information base may be established. When important legislative matters arise and disputes arise over sectoral interests, The legislative decision-making organ or the disputing parties may entrust a third-party evaluation agency to evaluate it. The third-party evaluation body shall follow certain evaluation procedures, An impartial evaluation report should be made on the basis of consultation with the parties. The evaluation report should be translated into the decision of the legislative decision-making organ as an important basis for legislative decision making.
