【摘要】：我國2016年9月1日起實施的《慈善法》及其配套政策,雖然初步構(gòu)建起慈善組織認定的制度框架,但在"明確、量化、公正以及透明"等方面仍存在不足乃至缺陷。為此,我們應(yīng)積極借鑒國際上公益認定的有效方法及其相應(yīng)的制度安排。與我國存在相似性的日本公益法人認定制度,其制度背景、制度安排以及實際運作等內(nèi)容,可以為我國提供若干啟示和借鑒。鑒于日本經(jīng)驗,今后我國應(yīng)進一步改革社會組織登記制度,努力實現(xiàn)與慈善組織認定之間的制度性分離;認真討論有關(guān)慈善認定申請組織的行政救濟問題,立足法治原則并盡可能地通過法律條文以切實保障其合法權(quán)益;盡快出臺具有明確性、可操作性以及可預(yù)見性的認定標準,提高慈善組織認定的公平性和透明度。
[Abstract]:In September 1st 2016, the charity law and its supporting policies were implemented in China, although the institutional framework for the recognition of charitable organizations was preliminarily constructed, there are still deficiencies and even defects in such aspects as "clarity, quantification, fairness and transparency". We should actively draw lessons from the effective methods of international public welfare recognition and its corresponding institutional arrangements. The Japanese public interest legal person identification system, which is similar to our country, its institutional background, institutional arrangement and actual operation, etc., should be actively used for reference. In view of the experience of Japan, we should further reform the registration system of social organizations and strive to realize the institutional separation from the recognition of charitable organizations. We should seriously discuss the issue of administrative relief for organizations applying for charitable recognition, base themselves on the principle of the rule of law and adopt legal provisions as far as possible to effectively protect their legitimate rights and interests, and issue as soon as possible the standards for the determination of their legal rights and interests, which are clear, operable and predictable. To improve the fairness and transparency of charitable organizations' recognition.
