【摘要】：近年來(lái),蘇丹紅、毒豇豆、地溝油、三聚氰胺奶、瘦肉精、染色饅頭等一系列食品安全事件的發(fā)生,讓我國(guó)消費(fèi)者對(duì)食品安全與衛(wèi)生問(wèn)題產(chǎn)生了巨大的質(zhì)疑和危機(jī)感,嚴(yán)重影響了社會(huì)的穩(wěn)定和食品的國(guó)際競(jìng)爭(zhēng)力；而且,對(duì)于我國(guó)出口到國(guó)外的缺陷食品,已經(jīng)建立健全了食品召回制度的國(guó)家就可以嚴(yán)格按照它們的法律程序要求我國(guó)食品生產(chǎn)經(jīng)營(yíng)者召回,而對(duì)于外國(guó)出口到我國(guó)的缺陷食品,由于我國(guó)的食品召回制度才剛剛起步,還存在很多缺陷,因此無(wú)法順利、快捷的要求國(guó)外生產(chǎn)經(jīng)營(yíng)者召回他們的缺陷食品,這不僅會(huì)嚴(yán)重?fù)p害我國(guó)消費(fèi)者的生命財(cái)產(chǎn)安全,而且對(duì)我國(guó)的食品生產(chǎn)經(jīng)營(yíng)者也是不公平的。 目前,美國(guó)的食品召回制度已經(jīng)形成了比較完備的體系,可以說(shuō)在國(guó)際上是最為先進(jìn)的,因此,為保護(hù)我國(guó)消費(fèi)者的生命財(cái)產(chǎn)安全權(quán)以及出口企業(yè)的貿(mào)易公平權(quán),有必要對(duì)美國(guó)缺陷食品召回制度進(jìn)行研究。 為此,首先主要介紹美國(guó)食品召回制度的相關(guān)概念,召回的分類及特點(diǎn),以對(duì)美國(guó)食品召回制度作個(gè)初步的分析。其次,介紹美國(guó)食品召回制度的主要內(nèi)容,并著重闡述了其法律程序和技術(shù)支撐體系,法律程序包括一般程序和簡(jiǎn)易程序,技術(shù)支撐體系包括食品安全標(biāo)準(zhǔn)、食品風(fēng)險(xiǎn)評(píng)估、食品安全檢測(cè)、食品標(biāo)簽管理與信息溯源、食品召回保險(xiǎn)等,以便對(duì)美國(guó)食品召回制度作更深層次的分析。最后,分析了我國(guó)食品召回制度的現(xiàn)狀,并依照前面的論述以對(duì)我國(guó)食品召回制度的立法完善提供借鑒意義。
[Abstract]:In recent years, the occurrence of a series of food safety incidents, such as Sudan red, poisonous cowpea, gutter oil, melamine milk, lean meat essence, and dyed steamed bread, has made Chinese consumers have a huge suspicion and a sense of crisis about food safety and hygiene issues. It has seriously affected the social stability and the international competitiveness of food products. Moreover, for the defective food products exported by our country to foreign countries, Countries that have established and improved the food recall system can strictly comply with their legal procedures to require China's food producers and operators to recall. For defective foods exported to China from foreign countries, the food recall system in China has only just started. There are still many defects, so it is not possible to smoothly and quickly request foreign producers and operators to recall their defective food. This will not only seriously damage the life and property safety of consumers in our country, And to our country food production operator is also unfair. At present, the food recall system in the United States has formed a relatively complete system, which can be said to be the most advanced in the world. Therefore, in order to protect the right of life and property safety of Chinese consumers and the right to trade fairness of export enterprises, It is necessary to study the recall system of defective food in the United States. Therefore, first of all, it mainly introduces the related concepts, classification and characteristics of the food recall system in the United States, in order to make a preliminary analysis of the food recall system in the United States. Secondly, it introduces the main contents of the food recall system in the United States. The legal procedure and technical support system, which includes general procedure and summary procedure, includes food safety standard, food risk assessment, food safety detection, food label management and information traceability. In order to make a deeper analysis of the food recall system in the United States, the article analyzes the current situation of the food recall system in China, and provides a reference for the legislative perfection of the food recall system in our country according to the previous discussion.
