【摘要】：美國(guó)聯(lián)邦巡回上訴法院是美國(guó)歷史上第一所,也是唯一一所對(duì)專利案件有專門(mén)性管轄權(quán)的上訴法院,該院的建立一度備受質(zhì)疑與苛責(zé),而數(shù)年的發(fā)展完善令其成為美國(guó)科技高速進(jìn)步的重要推進(jìn)者,而該法院也成了此后建立的日本、韓國(guó)、我國(guó)臺(tái)灣地區(qū)等地的知識(shí)產(chǎn)權(quán)法院相繼學(xué)習(xí)的楷模。本文將以實(shí)踐為基礎(chǔ),從歷史背景出發(fā),分析聯(lián)邦巡回上訴法院的設(shè)立,運(yùn)行與司法影響。
[Abstract]:The Federal Circuit Court of appeals is the first history of the United States, is also the only one to have the special patent case appellate court jurisdiction, establish the hospital once been questioned and criticism, and several years of development it has become an important advance of American science and technology to improve the speed of progress, and the court has become established since then Japan, South Korea, a model of intellectual property court of Taiwan area in China have been learning. This paper is based on the practice, starting from the historical background, analysis of the establishment of the Federal Circuit Court of appeals, operation and judicial effect.
