壟斷行業(yè)高薪酬的法律規(guī)制問(wèn)題研究

【摘要】:壟斷行業(yè)高薪酬是指壟斷行業(yè)的薪酬水平因受行業(yè)性質(zhì)和薪酬制度的影響而明顯超出市場(chǎng)正常水平的一種經(jīng)濟(jì)現(xiàn)象。近幾年來(lái),壟斷行業(yè)的高薪酬現(xiàn)象一直飽受公眾的批評(píng),并且成為當(dāng)前收入分配改革的重點(diǎn)領(lǐng)域。壟斷行業(yè)的薪酬水平過(guò)高,就會(huì)拉大社會(huì)的貧富差距,變相侵占公眾的福利,降低市場(chǎng)資源的配置效率,不利于和諧社會(huì)的構(gòu)建。由于當(dāng)前我國(guó)的薪酬監(jiān)管法律不夠健全,導(dǎo)致壟斷行業(yè)高薪酬問(wèn)題長(zhǎng)期得不到有效解決。所以,積極完善相關(guān)法律制度,對(duì)規(guī)制壟斷行業(yè)的高薪酬尤為重要。針對(duì)壟斷行業(yè)高薪酬形成原因的復(fù)雜性、薪酬監(jiān)管環(huán)節(jié)的多元性,筆者提出了在薪酬的分配環(huán)節(jié)要完善工資總額預(yù)算管理制度、壟斷行業(yè)高管的限薪制度、個(gè)人所得稅制度等法律措施以實(shí)現(xiàn)對(duì)高薪酬的直接規(guī)制;在薪酬的形成環(huán)節(jié)要完善反壟斷制度、價(jià)格監(jiān)管制度、壟斷行業(yè)的紅利上繳制度等法律措施來(lái)控制壟斷利潤(rùn)的產(chǎn)生與支配,從而達(dá)到間接規(guī)制壟斷行業(yè)高薪酬的目的。 除引言與結(jié)語(yǔ)外,本文共分為四個(gè)部分。 第一部分是本文的論證前提。通過(guò)探討壟斷行業(yè)高薪酬的表現(xiàn)、產(chǎn)生原因以及危害,使我們對(duì)壟斷行業(yè)高薪酬有一個(gè)總體性的認(rèn)識(shí),總結(jié)出了壟斷行業(yè)高薪酬具有的表現(xiàn)形式多樣,產(chǎn)生原因復(fù)雜,危害深遠(yuǎn)的特點(diǎn)。 第二部分詳細(xì)考查了我國(guó)當(dāng)前規(guī)制壟斷行業(yè)高薪酬的法律制度。通過(guò)考察,指出了這些法律制度沒(méi)有對(duì)壟斷行業(yè)高薪酬的制度根源進(jìn)行規(guī)制,只是對(duì)薪酬的分配過(guò)程做了一些技術(shù)上的調(diào)整,并且存在許多缺陷,因而不可能從根本上消除壟斷行業(yè)高薪酬現(xiàn)象。 第三部分主要介紹了國(guó)外防范壟斷行業(yè)高薪酬的法律制度以及對(duì)我國(guó)的經(jīng)驗(yàn)借鑒。通過(guò)考察國(guó)外在壟斷行業(yè)中的反壟斷制度、價(jià)格監(jiān)管制度和壟斷行業(yè)的紅利上繳制度,為我們打開(kāi)規(guī)制壟斷行業(yè)高薪酬的新視角,即我國(guó)應(yīng)當(dāng)采取法律措施來(lái)控制壟斷利潤(rùn)的產(chǎn)生與支配,才能消除高薪酬產(chǎn)生的經(jīng)濟(jì)基礎(chǔ),從而實(shí)現(xiàn)間接規(guī)制高薪酬的目的。 第四部分是本文的結(jié)論。通過(guò)對(duì)比中外的法律實(shí)踐,并且考慮到我國(guó)壟斷行業(yè)高薪酬存在的特殊情況,提出了規(guī)制壟斷行業(yè)高薪酬的具體對(duì)策:需要構(gòu)建一個(gè)對(duì)高薪酬進(jìn)行直接規(guī)制與間接規(guī)制相結(jié)合的法律規(guī)制體系。這樣不僅可以防范壟斷行業(yè)薪酬水平的過(guò)快增長(zhǎng),還可以消除壟斷行業(yè)高新酬產(chǎn)生的制度根源。
[Abstract]:High pay in monopoly industry is an economic phenomenon that the pay level of monopoly industry is obviously exceeded the normal level of market because of the nature of industry and salary system. In recent years, the phenomenon of high salary in monopoly industry has been criticized by the public. And it has become a key area of the current income distribution reform. If the pay level of monopoly industries is too high, it will widen the gap between the rich and the poor in the society, encroach on the welfare of the public in disguise, and reduce the efficiency of the allocation of market resources. It is not conducive to the construction of a harmonious society. Because the current salary supervision law in our country is not perfect enough, the problem of high salary in monopoly industry can not be effectively solved for a long time. Therefore, we should actively improve the relevant legal system. In view of the complexity of the reasons for the formation of high salary in monopoly industry and the diversity of compensation supervision, the author puts forward that the budget management system of total salary should be improved in the distribution of salary. Monopoly industry executives pay limit system, personal income tax system and other legal measures to achieve the direct regulation of high pay, in the formation of compensation to improve the anti-monopoly system, price supervision system, The monopoly industry's dividend payment system and other legal measures to control the production and control of monopoly profits, so as to achieve the goal of indirectly regulating the monopoly industry's high salary. In addition to the introduction and conclusion, this article is divided into four parts. The first part is the premise of this paper. By discussing the performance, causes and harm of high pay in monopoly industry, we have a general understanding of high pay in monopoly industry. The characteristics of high salary in monopoly industry are summarized, such as various forms, complicated causes and far-reaching harm. The second part examines the current legal system of high pay in monopoly industry in China. Through investigation, the author points out that these legal systems do not regulate the system root of high pay in monopoly industry. Only some technical adjustments have been made to the process of salary distribution, and there are many defects, so it is impossible to eliminate the phenomenon of high salary in monopoly industry. The third part mainly introduces the foreign legal system of preventing the high salary of monopoly industry and the experience of our country. By investigating the antitrust system, the price supervision system and the dividend payment system of monopoly industry, the third part of this paper introduces the foreign legal system of preventing the high salary of monopoly industry and the experience of our country. For us to open up a new angle of view of regulating high pay in monopoly industry, that is, our country should take legal measures to control the generation and control of monopoly profits, in order to eliminate the economic basis of high pay and thus achieve the purpose of indirectly regulating high pay. Part 4th is the conclusion of this paper. By comparing the legal practice between China and foreign countries, and considering the special situation of high salary in monopoly industry of our country, This paper puts forward the concrete countermeasures to regulate the high salary in monopoly industry: it is necessary to construct a legal regulation system which combines direct regulation and indirect regulation of high salary, which can not only prevent the excessive increase of salary level in monopoly industry. It can also eliminate the system root of high-new pay in monopoly industry.
