論法學本科教育的改革

【摘要】:當前,我國的法學本科教育進行的如火如荼,但是我們培養(yǎng)出的法學本科畢業(yè)生既不符合學術(shù)人才的要求,也不能很快適應實務部門的需要。造成這個問題出現(xiàn)的原因是多方面的,其中有教育體制本身的問題,也有教學方式、課程設(shè)置、教師評價體系、考試與評估方面的問題,尤其2008年司法考試改革,允許應屆畢業(yè)生參加司法考試之后,司法考試給法學本科教育帶來的巨大影響等等,這些因素無疑暴露了法學本科教育存在的缺陷。中國法學教育已經(jīng)步入了必須改革的發(fā)展階段,筆者從一個受教育者的角度來分析我國法學本科教育存在的問題,進而提出改革的建議,只有這樣,,我國的法學教育才能走出困境。筆者將通過三章具體闡述如下: 第一章主要寫我國本科教育的現(xiàn)狀及其目標,將我國法學本科教育的現(xiàn)狀和目標分成兩節(jié)加以論述。第一節(jié)主要寫了新中國成立以來法學教育的發(fā)展歷程和我國法學本科教育的發(fā)展現(xiàn)狀,從而為后文寫法學本科教育存在的問題打下基礎(chǔ);第二節(jié)主要寫了我國法學教育的目標以及中外法學本科教育存在的差異,法學教育目標決定著法學教育的所有后續(xù)問題,因此在反思中國法學本科教育面臨的現(xiàn)實困境中,很有必要從反思我國法學本科教育的目標開始。 第二章是著重分析了法學本科教育中存在的問題,其中有教學方式、課程設(shè)置、教師評價體系、考試與評估、2008年司法考試改革允許應屆畢業(yè)生參加之后,對法學本科教育的沖擊和影響等等方面的問題,分為五節(jié)分別予以闡述。 第三章主要就法學本科教育改革的出路,提出了一點建議,以期對我國法學本科教育的改革有一定的啟發(fā)意義。
[Abstract]:At present, the undergraduate law education in our country is in full swing, but the undergraduate law graduates we cultivate do not meet the requirements of academic talents. Also can not adapt to the needs of practical departments. The causes of this problem are various, including the education system itself, but also teaching methods, curriculum, teacher evaluation system. The problems of examination and evaluation, especially the reform of judicial examination in 2008, have brought great influence to the undergraduate education of law after the new graduates are allowed to take the judicial examination. There is no doubt that these factors have exposed the defects of the undergraduate education of law. China's law education has entered a stage of development that must be reformed. The author analyzes the problems existing in the undergraduate education of law in China from the perspective of an educatee, and then puts forward some suggestions for reform, which is the only way. In order to get out of the dilemma, the author will expound the following through three chapters: The first chapter mainly describes the current situation and objectives of undergraduate education in China. The first section mainly describes the development of law education since the founding of new China and the development of law education in China. So as to lay a foundation for the problems existing in the undergraduate education of law in the later writing; The second section mainly describes the goal of law education in China and the differences between Chinese and foreign law education. The goal of law education determines all the follow-up issues of law education. Therefore, it is necessary to start with the goal of undergraduate law education in China. The second chapter focuses on the analysis of the problems in the undergraduate education of law, including teaching methods, curriculum, teacher evaluation system, examination and evaluation. After the judicial examination reform in 2008 allowed the new graduates to participate, the impact and influence on the undergraduate law education were divided into five sections respectively. The third chapter mainly puts forward some suggestions on the reform of undergraduate law education in order to enlighten the reform of law undergraduate education in China.
