【摘要】：司法考試是我國(guó)法官、檢察官、律師等法律職業(yè)的初選考試,只有通過(guò)國(guó)家司法考試,才有資格擔(dān)任法官、檢察官和從事律師等法律職業(yè)。其因記憶量大、難度高、通過(guò)率低等特點(diǎn),有“中華第一考”之稱。正因如上特點(diǎn),司法考試的公平性一直受到矚目。但是,從司法考試制度確立開始,幾次第四卷分?jǐn)?shù)分差過(guò)大引起了民眾尤其是考生的質(zhì)疑,也導(dǎo)致一些考生對(duì)司法部提起訴訟,本文介紹的一起考生訴司法部司考信息公開案便是其中的典型。筆者通過(guò)一系列研究,發(fā)現(xiàn)本案中反映出現(xiàn)我國(guó)司法考試信息公開制度的一些不足之處:比如“工作秘密”作為不公開的理由被濫用、《政府信息公開條例》的效力等級(jí)過(guò)低等。通過(guò)以上研究中發(fā)現(xiàn)的問(wèn)題,筆者試圖尋找一些完善司法考試信息公開制度的方法:如明確司考信息公開的內(nèi)容、限制“工作秘密”的使用、完善司法考試信息公開的制度等。
[Abstract]:Judicial examination is the primary examination of legal profession such as judges, prosecutors, lawyers and so on in our country. Only by passing the national judicial examination, can we be qualified as judges, prosecutors and lawyers. The difficulty is high, the passing rate is low and so on, which is called "the first examination in China". Because of the above characteristics, the fairness of the judicial examination has been attracting attention. However, from the establishment of the judicial examination system. Several times the scores of the fourth volume were too wide to cause people, especially candidates, to question, but also led to some candidates against the Ministry of Justice. This paper introduces a examinee v. the Department of Justice examination information disclosure case is one of the typical. The author through a series of studies. Found in this case reflects the emergence of our judicial examination information disclosure system some deficiencies: for example, "work secrets" as a reason for non-disclosure of the abuse. Through the problems found in the above research, the author tries to find some ways to improve the information disclosure system of judicial examination, such as clarifying the content of the information disclosure. Restrict the use of "work secret" and perfect the system of information disclosure of judicial examination.
